S.B. No. 1290
AN ACT
relating to the sale or use of certain refrigerants.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1302.453, Occupations Code, is amended
by amending Subsection (b) and adding Subsection (c) to read as
follows:
(b) It is an exception to the application of this section
with respect to a purchase of a refrigerant or equipment containing
a refrigerant in this state in violation of Section 1302.356 that
the refrigerant or equipment is purchased for use only in a motor
vehicle and that use is authorized by the United States
Environmental Protection Agency.
(c) An offense under this section is a Class C misdemeanor.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
