S.B. No. 348




AN ACT
relating to the availability of judges and magistrates for proceedings related to chemically dependent persons. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 462.0025, Health and Safety Code, is amended to read as follows: Sec. 462.0025. COURT HOURS. (a) The probate court or court having probate jurisdiction shall be open [at all times] for proceedings under this chapter during normal business hours. (b) The probate judge or magistrate shall be available at all times at the request of a person taken into custody or detained under Subchapter C or a proposed patient under Subchapter D. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
