A JOINT RESOLUTION
proposing a constitutional amendment relating to a moratorium on
the execution of persons convicted of capital offenses.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11, Article IV, Texas Constitution, is
amended by adding Subsection (c) to read as follows:
(c) The Texas Department of Criminal Justice is prohibited
from performing executions until September 1, 2007. This
subsection expires September 2, 2007.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment establishing a
moratorium on the execution of persons convicted of capital
offenses."
