H.B. No. 2667
AN ACT
relating to the election of a director of a municipal utility
district.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 54, Water Code, is amended
by adding Section 54.0225 to read as follows:
Sec. 54.0225. ELECTION OF DIRECTORS. (a) Notwithstanding
any other law, the county clerk, or the county officer who performs
the election duties of the county clerk, of the county in which the
district is located shall administer an election for a member of the
board. This section shall not apply to an election in a district in
which there are 10 or fewer qualified voters at the time the
election is called.
(b) If the district is located in more than one county, the
county clerk or other county officer of the county in which the most
inhabitants of the district reside shall perform the election
duties under Subsection (a).
(c) This section does not affect the duties of a board under
Section 49.103.
(d) The district shall pay the county for election services
required under this section in the manner provided by Subchapter D,
Chapter 31, Election Code, for a contract to furnish election
services.
SECTION 2. The change in law made by this Act applies to an
election for a director of a municipal utility district ordered on
or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2005.
