                                                                  H.B. No. 2140




AN ACT

relating to the provision of notice to affected political 
subdivisions regarding the proposed construction of a reservoir.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 11.124, Water Code, is amended by adding 
Subsection (f) to read as follows:
	(f)  If the application is for a permit to construct a 
storage reservoir, the application must also contain evidence that 
the applicant has mailed notice of the application to each member of 
the governing body of each county and municipality in which the 
reservoir, or any part of the reservoir, will be located.
	SECTION 2.  The change in law made by this Act applies only 
to an application for a permit filed with the Texas Commission on 
Environmental Quality on or after the effective date of this Act.  
An application filed before the effective date of this Act is 
governed by the law in effect on the date the application was filed, 
and the prior law is continued in effect for that purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
