H.B. No. 1562
AN ACT
relating to the authority of a local government to enter into an
interlocal contract with a federally recognized Indian tribe.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 791.011, Government Code, is amended by
amending Subsection (a) and adding Subsection (b-1) to read as
follows:
(a) A local government may contract or agree with another
local government or a federally recognized Indian tribe, as listed
by the United States secretary of the interior under 25 U.S.C.
Section 479a-1, whose reservation is located within the boundaries
of this state to perform governmental functions and services in
accordance with this chapter.
(b-1) A local government that is authorized to enter into an
interlocal contract under this section may not contract with an
Indian tribe that is not federally recognized or whose reservation
is not located within the boundaries of this state.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
