H.B. No. 1165
AN ACT
relating to the employment of county traffic officers by certain
counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 701.001, Transportation Code, is amended
to read as follows:
Sec. 701.001. AUTHORIZATION. (a) Except as provided by
Subsection (c), acting [Acting] in conjunction with the sheriff of
the county, the commissioners court of a county may employ not more
than five regular deputies as county traffic officers.
(b) Except as provided by Subsection (c), the [The]
commissioners court may employ not more than two additional
deputies as county traffic officers to aid the regular officers in
special emergencies.
(c) The limitation on the number of deputies that may be
employed under Subsections (a) and (b) does not apply to a county
with a population of more than two million.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
