H.B. No. 535
AN ACT
relating to the offense of using a sound amplification device near a
polling place.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Section 61.004, Election Code, is
amended to read as follows:
Sec. 61.004. UNLAWFUL OPERATION OF SOUND AMPLIFICATION
DEVICE OR SOUND TRUCK.
SECTION 2. Section 61.004(a), Election Code, is amended to
read as follows:
(a) A person commits an offense if, during the voting period
and within 1,000 feet of a building in which a polling place is
located, the person operates a sound amplification device or a
vehicle with a loudspeaker while the device or loudspeaker is being
used for the purpose of:
(1) making a political speech; or
(2) electioneering for or against any candidate,
measure, or political party.
SECTION 3. This Act takes effect September 1, 2005.
