A BILL TO BE ENTITLED
AN ACT
relating to the use of the special education allotment to fund Saturday classes for certain students. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 42.151, Education Code, is amended by amending Subsection (h) and adding Subsection (m) to read as follows: (h) Except as provided by Subsection (m), funds [Funds] allocated under this section, other than an indirect cost allotment established under State Board of Education rule, must be used in the special education program under Subchapter A, Chapter 29. (m) Notwithstanding any other provision of law, a school district may use funds allocated under this section to provide Saturday classes for third grade students who fail to perform satisfactorily on an assessment instrument administered under Section 39.023. SECTION 2. This Act applies beginning with the 2005-2006 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
