Amend Amendment No. 113 by Gallego to CSSB 1 (page 103,
prefiled amendments) as follows:
(1) Strike page 1, lines 5 through 21, and substitute the
following:
Sec. . Limitation on Expenditure of Appropriated Funds.
(a) An institution of higher education may not spend money
appropriated by this Act for the state fiscal year beginning
September 1, 2005, to conduct the educational programs of the
institution if in the 2005-2006 academic year the institution
charges any student of the institution tuition under Section
54.0513, Education Code, in an amount in excess of 103 percent of
the amount of tuition charged to a similarly situated student in the
2004-2005 academic year.
(b) An institution of higher education may not spend money
appropriated by this Act for the state fiscal year beginning
September 1, 2006, to conduct the educational programs of the
institution if in the 2006-2007 academic year the institution
charges any student of the institution tuition under Section
54.0513, Education Code, in an amount in excess of 103 percent of
the amount of tuition charged to a similarly situated student in the
2005-2006 academic year.
