         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Special Select Subcommittee was  
         held on Monday, May 5, 2003, in the Capitol Extension, Room  
         E1.028, at Austin, Texas. 
         MEMBERS PRESENT:                        MEMBERS ABSENT: 
         Senator Jeff Wentworth 
         Senator Bob Deuell                       
         Senator Eliot Shapleigh                  
         Senator Jeff Wentworth, called the meeting to order at 9:08 a.m.   
         There being a quorum present, the following business was  
         Senator Deuell moved adoption of the minutes from the previous  
         hearings held on April 10, 2003, and April 22, 2003; without  
         objection, it was so ordered.   
         Senator Deuell sent up a committee substitute to HB 1191.   
         Senator Deuell moved adoption of the committee substitute;  
         without objection, it was so ordered   
         At 9:11 a.m. Senator Deuell assumed the chair.    
         The chair recognized Senator Wentworth to explain the difference  
         between the committee substitute and the bill as filed.  
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
         At 9:48 a.m. Senator Wentworth resumed the chair. 
         Senator Wentworth moved that HB 1191 do not pass but that CSHB  
         1191 be reported back to the full committee with the  
         recommendation that it do pass.  The motion carried with a  
         record vote of 2 ayes, 0 nay, 0 present not voting, and 1  
         There being no further business, at 09:51 a.m. Senator Wentworth  
         moved that the Subcommittee stand recessed subject to the call  
         of the chair.  Without objection, it was so ordered.
