         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Infrastructure Development  
         and Security Committee was held on Monday, March 3 2003, in the  
         Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 10:01 a.m.  There being  
         a quorum present, the following business was transacted:     
          
         Senator Madla moved adoption of the minutes from the previous  
         hearing held on February 24, 2003.  Senator Deuell seconded the  
         motion; without objection, it was so ordered.  
          
         The chair laid out SB 305, relating to specialized license  
         plates and parking placards for vehicles of persons with  
         disabilities, and recognized the author, Senator Barrientos, to  
         explain the bill.  Senator Ogden moved that SB 305 be left  
         pending awaiting public testimony. 
          
         The chair laid out SB 355, relating to public health  
         preparedness; providing criminal penalties, and recognized the  
         author, Senator Janek, to explain the bill.  Senator Ogden moved  
         that SB 355 be left pending awaiting public testimony. 
          
         The chair laid out SB 404, relating to advanced transportation  
         districts, and recognized the author, Senator Madla, to explain  
         the bill. Senator Madla sent up a committee substitute; the  
         chair recognized Senator Madla to explain the difference between  
         the committee substitute and the bill as filed. Senator Ogden  
         moved that SB 404 be left pending awaiting public testimony.      
         The chair laid out SB 439, relating to a motor vehicle with an  
         altered or obscured license plate, and recognized the author,  
         Senator Lindsay, to explain the bill.  Senator Ogden moved that  
         SB 439 be left pending awaiting public testimony. 
          
         At 10:23 a.m. Senator Barrientos assumed the chair.  
          
         The chair laid out SB 660, relating to the penalty for certain  
         speeding offenses, and recognized the author, Senator Ogden, to  
         explain the bill. Senator Barrientos moved that SB 660 be left  
  
         pending awaiting public testimony. 
          
         At 10:30 a.m. Senator Ogden resumed the chair. 
          
         The chair referred SB 668, relating to the issuance of Knights  
         of Columbus license plates, to the Special Select Subcommittee  
         for further consideration.  
          
         The chair laid out SB 361, relating to the precedence of certain  
         municipal highway access rules and ordinances over highway  
         access management orders of the Texas Transportation Commission,  
         and recognized the author, Senator Shapiro, to explain the bill.   
         Senator Ogden moved that SB 361 be left pending awaiting public  
         testimony.   
          
         Public testimony was then taken on SB 305.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 305  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out SB 399, relating to the powers and duties of  
         the governor and certain state          agencies relating to  
         public health, including public health emergencies, and  
         recognized the author, Senator Van de Putte, to explain the  
         bill.  Senator Ogden moved that SB 399 be left pending awaiting  
         public testimony. 
          
         Public testimony was then taken on SB 361.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 361  
         be left pending; without objection, it was so ordered.   
                                   
         The chair laid out SB 209 by Carona, relating to prohibiting a  
         motor vehicle from being equipped with certain video equipment  
         and devices, which had been left pending from a previous  
         hearing.  Senator Wentworth sent up a committee substitute; the  
         chair recognized Senator Wentworth to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Wentworth moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator Barrientos requested  
         unanimous consent to be shown voting aye on CSSB 209.  There  
         being no objection, it was so ordered.  Senator Shapleigh  
         requested unanimous consent to be shown voting aye on CSSB 209.   
         There being no objection, it was so ordered.  Senator Wentworth  
         moved that SB 209 do not pass but that CSSB 209 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Public testimony was then taken SB 355.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Ogden moved that SB 355 be left pending; without  
         objection, it was so ordered.   
                                        
         Public testimony was then taken on SB 399.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Ogden moved that SB 399 be left pending; without  
         objection, it was so ordered.            
  
         Public testimony was then taken on SB 404.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 404  
         be left pending; without objection, it was so ordered.   
                                   
         Public testimony was then taken on SB 439.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 439  
         be left pending; without objection, it was so ordered.   
          
         Public testimony was then taken on SB 660.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 660  
         be left pending; without objection, it was so ordered.   
          
         There being no further business, at 1:08 p.m. Senator Ogden  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
