         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Infrastructure Development  
         and Security Committee was held on Monday, February 24, 2003, in  
         the Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 11:35 a.m.  There being  
         a quorum present, the following business was transacted:     
          
         Senator Wentworth moved adoption of the minutes from the  
         previous hearing held on February 17, 2003.  Senator Shapleigh  
         seconded the motion; without objection, it was so ordered.   
          
         The chair laid out SB 209 and recognized the author, Senator  
         Carona, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 209  
         be left pending; without objection, it was so ordered.   
                                                            
         The chair referred SB 425 to the Special Select Subcommittee for  
         further consideration.    
          
         The chair laid out SB 94, which had been left pending from a  
         previous hearing. Senator Shapiro requested unanimous consent to  
         be shown voting aye on SB 94.  There being no objection, it was  
         so ordered.  Senator Ogden moved that SB 94 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present  not voting, and 1 absent.   
  
         The chair laid out SB 165, which had been left pending from a  
         previous hearing. Senator Lindsay sent up Committee Amendment 1  
         on SB 165 and moved adoption; without objection, the amendment  
         was adopted.  Senator Ogden requested unanimous consent to roll  
         the amendments into a new committee substitute; without  
         objection, it was so ordered.  Senator Ogden then moved that the  
         committee substitute be adopted; without objection, it was so  
         ordered. Senator Shapiro requested unanimous consent to be shown  
         voting aye on CSSB 165.  There being no objection, it was so  
         ordered.  Senator Lindsay moved that SB 165 do not pass but that  
         CSSB 165 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.   
                                                       
         The chair laid out SB 204, which had been left pending from a  
         previous hearing. Senator Shapiro requested unanimous consent to  
         be shown voting aye on SB 204.  There being no objection, it was  
         so ordered. Senator Wentworth moved that SB 204 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present not voting, and 1 absent.             
          
         There being no further business, at 11:54 a.m. Senator Ogden  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
