         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Infrastructure Development  
         and Security Committee was held on Monday, February 17, 2003, in  
         the Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 10:00 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Shapleigh moved adoption of the minutes from the  
         previous hearing held on February 10, 2003; Senator Shapiro  
         seconded the motion. Senator Wentworth moved to be shown  
         present, not voting; without objection, it was so ordered, and  
         the minutes were adopted. 
          
         The chair laid out SB 204 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list. The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that SB 204  
         be left pending; without objection, it was so ordered.   
          
         The chair referred SB 365 and SB 293 to the Special Select  
         Subcommittee for further consideration.  The chair also charged  
         the subcommittee to review the report from the Governor's  
         Taskforce on Homeland Security and its recommendations.           
          
         The chair laid out SB 249 and recognized Senator Wentworth, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Ogden moved that  
         SB 249 be left pending; without objection, it was so ordered.   
          
         Senator Barrientos moved that SB 193 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.      
          
         Senator Ogden then recognized Michael Behrens, Executive  
         Director of the Texas Department of Transportation, to testify  
         about a recent accident on Interstate Highway 35. 
          
         The chair laid out SB 94 and recognized the author, Senator  
         West, to explain the bill. Witnesses testifying and registering  
         on the bill are shown on the attached list.  The chair moved  
         that the public testimony be closed; without objection, it was  
         so ordered.  Senator Ogden moved that SB 94 be left pending;  
         without objection, it was so ordered.    
          
         Senator Ogden then moved that public testimony on SB 249 be  
         re-opened in order to hear testimony from two representatives  
  
         from the Texas Comptroller of Public Accounts.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. The chair moved that the public testimony be closed;  
         without objection, it was so ordered.   
          
         There was no action taken for the following bill(s): SB 165 and  
         SB 209. 
          
         There being no further business, at 10:54 a.m. Senator Ogden  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
