         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Health &  
         Human Services was held on Tuesday, May 6, 2003, in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 9:00 a.m.  The  
         following business was transacted:   
          
         The Chair laid out House Bill 861 and recognized its Senate  
         sponsor, Senator Madla, to explain the bill. 
          
         Senator Madla explained the bill. 
          
         The Chair opened the floor for public testimony on House Bill  
         861.  Witnesses testifying and registering on the bill are shown  
         on the attached list.   
          
         The Chair closed public testimony. 
          
         The Chair announced that the bill would be left pending. 
          
         The Chair laid out Senate Bill 1587 and recognized its author,  
         Senator Lindsay, to explain the bill. 
          
         Senator Lindsay explained the bill. 
          
         The Chair opened the floor for public testimony on Senate Bill

         The Chair laid out House Bill 1743 and recognized its Senate  
         Sponsor, Senator Nelson, to explain the bill. 
          
         Senator Nelson explained the bill and sent up Committee  
         Amendment 1. 
          
         The Chair opened the floor for public testimony on House Bill  
         1743.  Witnesses testifying and registering on the bill are

         At 9:25 a.m. Senator Nelson resumed the chair.   
          
         The Chair laid out House Bill 3484 and recognized its Senate  
         sponsor, Senator Deuell, to explain the bill.

         Senator Carona, to explain the bill. 
          
         Senator Carona sent up a committee substitute; the Chair  
         recognized Senator Carona to explain the difference between the  
         committee substitute and the bill as filed.  Senator Carona  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.   

         Senator Carona sent up Committee Amendment 1. 
          
         The Chair opened the floor for public testimony on Senate Bill  
         769.  Witnesses testifying and registering on the bill are shown  
         on the attached list.

         Senator Carona withdrew Committee Amendment 1. 
          
         The Chair announced that the bill would left be pending.          
          
         The Chair laid out House Bill 727 and recognized its Senate  
         sponsor, Senator Janek, to explain the bill. 
          
         Senator Janek explained the bill. 
          
         Senator Janek sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.   
          
         The Chair opened the floor for public testimony on House Bill  
         727.  Witnesses testifying and registering on the bill are shown

         The Chair announced that the bill would be left pending. 
          
         The Chair laid out House Bill 1735 and recognized its Senate  
         sponsor, Senator Janek, to explain the bill. 
          
         Senator Janek explained the bill. 
          
         The Chair opened the floor for public testimony on House Bill

         Senator Janek moved that the minutes from the previous two  
         hearings be approved; without objection, the motion carried. 
          
         The Chair recalled House Bill 1735 which had previously been  
         left pending. 
          
         Senator Janek moved that House Bill 1735 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Lindsay asked  
         to be shown voting aye; without objection, it was so ordered. 

         Senator Janek moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair recalled House Bill 861 which had previously been left  
         pending. 
          
         Senator Janek moved that House Bill 861 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Lindsay asked  
         to be shown voting aye; without objection, it was so ordered. 
          
         Senator Janek moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair recalled Senate Bill 769 which had previously been  
         left pending. 
          
         Senator Carona moved that Senate Bill 769 do not pass but that  
         CSSB 769 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nays, 0 present not voting, and 2  
         absent.  Senator Lindsay asked to be shown voting aye; without  
         objection, it was so ordered. 
          
         Senator Carona moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair recalled House Bill 3484 which had previously been  
         left pending. 
          
         Senator Deuell moved that House Bill 3484 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nays, 0 present not voting, and 2 absent.  Senator Lindsay asked  
         to be shown voting aye; without objection, it was so ordered. 
          
         Senator Deuell moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair recalled Senate Bill 787 which had previously been  
         left pending. 
          
         Senator Carona moved that Senate Bill 787 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 0  
         nays, 0 present not voting, and 3 absent.   
          
         Senator Carona moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         There being no further business, at 10:20 a.m. Senator Janek  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
