         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Health &  
         Human Services was held on Tuesday, March 4, 2003, in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 2:00 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Zaffirini moved that the minutes from the previous  
         hearing be approved; without objection, the minutes were  
         approved by unanimous consent. 
          
         The Chair laid out Senate Bill 40 and recognized its author,  
         Senator Zaffirini, to explain the bill. 
          
         Senator Zaffirini explained the bill. 
          
         The Chair opened the floor for public testimony.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. 
          
         The Chair closed public testimony and announced that Senate Bill  
         40 would be left pending. 
          
         The Chair laid out Senate Bill 314 and recognized its author,  
         Senator Janek, to explain the bill. 
          
         Senator Janek explained the bill. 
  
         The Chair opened the floor for public testimony.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. 
          
         The Chair closed public testimony and announced that Senate Bill  
         314 would be left pending. 
          
         The Chair laid out Senate Bill 327 and recognized its author,  
         Senator Janek, to explain the bill. 
          
         Senator Janek explained the bill. 
          
         The Chair opened the floor for public testimony.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. 
          
         The Chair closed public testimony and announced that Senate Bill  
         327 would be left pending. 
          
         The Chair laid out Senate Bill 491 and recognized its author,  
         Senator Shapleigh, to explain the bill. 
          
         Senator Shapleigh explained the bill. 
          
         The Chair opened the floor for public testimony.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list. 
          
         The Chair closed public testimony. 
          
         The Chair recognized Senator Janek for a motion. 
          
         Senator Janek moved that Senate Bill 491 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nays, and 1 absent.  Senator Zaffirini asked to be shown voting  
         aye; without objection, the motion carried. 
          
         The Chair recalled Senate Bill 40, which had previously been  
         left pending, and recognized Senator Gallegos for a motion. 
          
         Senator Gallegos moved that SB 40 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nays, and 1  
         absent.  Senator Zaffirini asked to be shown voting aye; without  
         objection, the motion carried. 
          
         Senator Carona moved that Senate Bill 40 be recommended for the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.  
          
         The Chair recognized Senator Gallegos for a motion.

         Senator Gallegos moved that Senate Bill 491 be recommended for  
         the Local & Uncontested Calendar; without objection, the motion  
         carried. 
          
         The Chair recalled Senate Bill 314, which had previously been  
         left pending, and recognized Senator Janek for a motion.  
          
         Senator Janek moved that SB 314 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 2 nays, and 2  
         absent.  Senator West asked to be shown voting nay; without  
         objection, the motion carried. 
            
         The Chair recalled Senate Bill 327, which had previously been  
         left pending, and recognized Senator Janek for a motion.  
          
         Senator Janek moved that SB 327 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nays, and 1  
         absent.  Senators West and Zaffirini asked to be shown voting  
         aye; without objection, the motion carried.  
          
         Senator Gallegos moved that Senate Bill 327 be recommended for  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         There being no further business, at 3:29 p.m. Senator Nelson  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
