Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Natural
Resources was held on Thursday, April 10, 2003, in the Senate
Chamber at Austin, Texas.

The chair called the meeting to order at 1:20 p.m. There being
a quorum present, the following business was transacted:
At 1:25 p.m. Senator Fraser assumed the chair.
The chair brought up HB 43 from pending business. Senator
Armbrister had previously, on April 8, 2003, sent up a committee
substitute. Senator Armbrister moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Armbrister moved that HB 43 do not pass but that CSHB 43 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 6
ayes, 0 nay, 0 present not voting, and 5 absent. Senator
Armbrister moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The chair brought up HB 535 from pending business. Senator
Armbrister moved that HB 535 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 6 ayes, 0 nay, 0 present
not voting, and 5 absent. Senator Armbrister moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
At 1:30 p.m. Senator Armbrister resumed the chair.

Lindsay moved that HB 1138 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The

be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
The chair brought up SB 738 from pending business. At the
request of the author, SB 738 was left pending.
The chair brought up SB 743 from pending business. Senator
Lucio, Jr. had previously, on April 8, 2003, sent up a committee
substitute. Senator Lucio, Jr. moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Lucio, Jr. moved that SB 743 do not pass but that CSSB 743 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 6
ayes, 0 nay, 0 present not voting, and 5 absent. Senator Lucio,
Jr. moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so

The chair brought up SB 854 from pending business. Senator
Lindsay had previously sent up Committee Amendment 1 that was
adopted, without objection, on April 8, 2003. Senator Lindsay
sent up a committee substitute; the chair recognized Senator
Lindsay to explain the difference between the committee
substitute and the bill as filed. Senator Lindsay moved
adoption of the committee substitute; without objection, it was
so ordered. Senator Lindsay requested unanimous consent to
incorporate the amendment into the committee substitute;
without objection, it was so ordered. Senator Lindsay then
moved that the new committee substitute be adopted; without
objection, it was so ordered. Senator Lindsay moved that SB 854
do not pass but that CSSB 854 be reported back to the Senate
with the recommendation that it do pass and be printed. The

Subcommittee on Agriculture on March 27, 2003, from pending
business. Senator Armbrister moved that SB 498 do not pass but
that CSSB 498 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 6 ayes, 0 nay, 0 present not
voting, and 5 absent. Senator Armbrister moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 1:50 p.m. Senator Armbrister resumed the chair.
There being no further business, at 1:50 p.m. Senator Armbrister
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
