Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Natural
Resources was held on Tuesday, March 18, 2003, in the Capitol
Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 2:40 p.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 822 and recognized the author, Senator
Fraser, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Fraser moved that SB 822
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent.
Senator Fraser moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
Senators Jackson, Barientos, Duncan, Hinojosa and Shapiro
requested unanimous consent to be shown aye on SB 822; without
objection, it was so ordered.
The chair laid out SB 761 and recognized the author, Senator
Estes, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Estes moved that SB 761
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 11 ayes, 0 nay, 0 present not voting, and 0 absent.

objection, it was so ordered. Senator Lindsay moved that SJR 30
be left pending; without objection, it was so ordered.
The chair laid out SB 623 and recognized the author, Senator
Lindsay, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Lindsay sent up a
committee substitute; the chair recognized Senator Lindsay to
explain the difference between the committee substitute and the
bill as filed. Senator Lindsay sent up Committee Amendment 1
and moved adoption; without objection, the amendment was
adopted. Senator Lindsay moved that SB 623 be left pending;
without objection, it was so ordered.
The chair laid out SB 155 and recognized the author, Senator
Zaffirini, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Jackson sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed.
Senator Barrientos sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
Fraser sent up Committee Amendment 2 and moved adoption; without
objection, the amendment was adopted. Senator Estes sent up
Committee Amendment 3 and moved adoption; without objection, the
amendment was adopted. Senator Estes sent up Committee
Amendment 4 and moved adoption; without objection, the amendment
was adopted.
Senator Lucio, Jr. sent up Committee Amendment 5 and moved
adoption; without objection, the amendment was adopted. Senator
Barrientos requested unanimous consent to roll the amendments
into a committee substitute; without objection, it was so
ordered. Senator Barrientos then moved that the committee
substitute be adopted; without objection, it was so ordered.
Senator Barrientos moved that SB 155 do not pass but that CSSB
155 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 10 ayes, 0 nay, 0 present not voting, and 1 absent.
At 6:15 p.m. Senator Estes assumed the chair.
Senators Lindsay, Shaprio and Staples requested unanimous
consent to be shown voting aye on CSSB 155; without objection,
it was so ordered.
At 6:20 p.m. Senator Armbrister resumed the chair.
There being no further business, at 7:35 p.m. Senator Armbrister
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
