         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Jurisprudence  
         was held on Wednesday, July 23, 2003, in the Capitol Extension  
         Auditorium at Austin, Texas.

         The chairman called the meeting to order at 9:42 a.m.  There  
         being a quorum present, the following business was transacted:   
          
         The chairman laid out pending business HB 3. 
          
         At 9:43 a.m. Senator Staples offered opening statements on Plan  
         01327C.   The committee proceeded to discuss the plan.  
          
         The committee heard invited testimony, shown on the attached  
         list. 
          
         At 10:19 a.m. Senator Gallegos assumed the chair.   
          
         At 10:22 a.m. Senator Duncan resumed the chair.   
          
         Senator Staples sent up a committee substitute to HB 3 (Plan  
         01327C).  Senator Staples moved to adopt the committee  
         substitute.  The motion carried with a record vote of 4 ayes, 3  
         nays, 0 present not voting, and 0 absent.   
          
         Senator Staples moved that HB 3 do not pass but that CSHB 3 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 4  
         ayes, 3 nays, 0 present not voting, and 0 absent.   
          
         Senators Harris, West, Lucio, Gallegos, Averitt, Staples offered  
  
         closing statements.  
          
         The chairman offered closing statements. 
          
         There being no further business, at 11:11 a.m. Senator Duncan  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
