         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Jurisprudence  
         was held on Wednesday, July 9, 2003, in Waco, Texas

         The chair called the meeting to order at 1:30 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair introduced the translator, Dan Carroll. The chair  
         offered welcoming comments.  Senators Averitt, Harris, West,  
         Gallegos, and Van de Putte offered welcoming comments.  The  
         chair introduced the attorneys, Mike Morrison, David Guinn, and  
         Bob Heath. 
          
         Senator Gallegos moved that the committee limit testimony to  
         five minutes.  The motion carried with a record vote of 5 ayes,  
         0 nays, 2 absent, and 0 present not voting.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
                                                                 
         At 3:06 p.m. Senator Duncan moved that the committee stand  
         recessed until 3:20 p.m; without objection, it was so ordered.   
          
         At 3:20 p.m. the chair called the meeting to order and continued  
         with public testimony. 
                                                                      
         At 4:45 p.m. Senator Duncan moved that the committee stand  
         recessed until 5:00 p.m; without objection, it was so ordered.     
         At 5:10 p.m. the chair called the meeting to order and continued  
         with public testimony.    
          
         At 5:55 p.m. Senator Gallegos assumed the chair.   
          
         At 6:09 p.m. Senator Duncan resumed the chair.   
          
         At 6:35 p.m. Senator Duncan moved that the committee stand  
         recessed until 6:50 p.m; without objection, it was so ordered.   
          
         At 7:00 p.m. the chair called the meeting to order and continued  
         with public testimony.    
               
         At 8:40 p.m. Senator Duncan moved that the committee stand  
         recessed until 8:55 p.m; without objection, it was so ordered.         
          
         At 9:00 p.m. the chair called the meeting to order and continued  
         with public testimony.    
          
         At 10:28 p.m. Senator Duncan moved that the committee stand  
         recessed until 10:45 p.m; without objection, it was so ordered.   
          
         At 10:53 p.m. the chair called the meeting to order and  
         continued with public testimony.    
          
         At 11:23 p.m. the chair moved that the interpreter be allowed to  
         be dismissed since there appears to be no one in the audience  
         who desires those services.  Without objection, the interpreter  
         was dismissed.       
          
         At 11:34 p.m. Senator Gallegos assumed the chair.   
          
         At 11:35 p.m. Senator Duncan resumed the chair.         
          
         At 12:35 a.m., Senator Gallegos moved that all remaining cards  
         of people not wishing to testify be added to the record.  The  
         motion passed with a record vote of 4 ayes, 0 nays, 3 absent,  
         and 0 present not voting.   
          
         There being no further business, the Committee stood recessed  
         subject to the call of the chair.
