         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Jurisprudence  
         was held on Monday, April 14, 2003, in the Senate Chamber at  
         Senator Duncan's Desk.

         The chair called the meeting to order at 4:02 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out pending business SB 424.  Senator Averitt  
         moved that SB 424 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 1 nay, 0 present not  
         voting, and 0 absent.   
          
         The chair laid out pending business SB 604.  Senator Lucio sent  
         up a committee substitute; the chair recognized Senator Ellis to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lucio moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator Lucio  
         moved that SB 604 do not pass but that CSSB 604 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 0 absent.  Senator Harris moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 828 and recognized the  
         author, Senator Whitmire, to explain the bill.  Senator West  
         sent up a committee substitute; the chair recognized Senator  
         Whitmire to explain the difference between the committee  
  
         substitute and the bill as filed.  Senator West moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator West moved that SB 828 do not pass but that  
         CSSB 828 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Harris moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The chair laid out pending business SB 1165.  Senator Lucio  
         moved that SB 1165 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 0 nay, 0 present not  
         voting, and 0 absent.  Senator Lucio moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.     
          
         The chair laid out HB 462 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Senator Lucio moved that HB  
         462 be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Harris moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Gallegos assumed the chair.   
          
         The chair laid out pending business SJR 33 and recognized the  
         author, Senator Duncan, to explain the bill.  Senator Duncan  
         moved that SJR 33 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 1 nay, 0 present not  
         voting, and 0 absent.   
          
         The chair laid out pending business SB 794 and recognized the  
         author, Senator Duncan, to explain the bill.  Senator Duncan  
         moved that SB 794 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 1 nay, 0 present not  
         voting, and 0 absent.   
          
         Senator Duncan resumed the chair.   
          
         The chair laid out pending business SB 1206.  Senator Harris  
         sent up a committee substitute; the chair recognized Senator  
         Harris to explain the difference between the committee  
         substitute and the bill as filed.  Senator Harris moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Harris moved that SB 1206 do not pass but that  
         CSSB 1206 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 5 ayes, 1 nay, 1 present not voting, and 0  
  
         absent.   
          
         Senator Gallegos assumed the chair.   
          
         The chair laid out pending business CSSB 1207 and recognized the  
         author, Senator Duncan, to explain the bill.  Senator Duncan  
         moved that SB 1207 be left pending; without objection, it was so  
         ordered.   
          
         Senator Duncan resumed the chair.   
          
         The chair laid out pending business SB 1564.  Senator Lucio sent  
         up a committee substitute; the chair recognized Senator Lucio to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lucio moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator Lucio  
         moved that SB 1564 do not pass but that CSSB 1564 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Lucio moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1781.  Senator Gallegos  
         sent up a committee substitute; the chair recognized Senator  
         Gallegos to explain the difference between the committee  
         substitute and the bill as filed.  Senator Gallegos moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Lucio moved that SB 1781 do not pass but  
         that CSSB 1781 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Harris moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business SB 1797.  Senator Lucio sent  
         up a committee substitute; the chair recognized Senator Lucio to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lucio moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator Lucio  
         moved that SB 1797 do not pass but that CSSB 1797 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Harris moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1889.  Senator Harris  
         moved that SB 1889 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         Senator West asked unanimous consent to be shown voting aye on  
         SB 1781, SB 1797 and SB 1889.  Without objection, it was so  
         ordered.   
          
         There being no further business, Senator Duncan moved that the  
         Committee stand recessed subject to the call of the chair.   
         Without objection, it was so ordered.   
          
         There was no action taken for the following bill(s): SB 1180.
