         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Jurisprudence  
         was held on Wednesday, February 19, 2003, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.  On Thursday, February  
         20, 2003, following a suspension of Senate Rules 11.10 and 11.18  
         by the full Senate, a hearing of the Senate Committee on  
         Jurisprudence was held at Chairman Duncan's desk on the Senate  
         floor upon adjournment of the Senate.

         February 19, 2003: 
         The following members arrived after the roll was called:   
         Senator Royce West 
          
         The chair called the meeting to order at 1:35 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Harris moved adoption of the minutes from the previous  
         hearing held on February 5, 2003; without objection, it was so  
         ordered.   
          
         The chair laid out SB 375 and recognized the author, Senator  
         Williams, to explain the bill.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Harris moved that SB 375 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 4 ayes, 0 nay, 0  
         present not voting, and 3 absent.   
          
         The chair laid out SB 164 and recognized the author, Senator  
         Lindsay, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
  
         objection, it was so ordered.  Senator Harris moved that SB 164  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent.   
          
         The chair laid out SB 151 and recognized Senator Harris, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Harris moved that  
         SB 151 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 3 absent.   
          
         The chair laid out SB 379 and recognized Senator Harris, in the  
         absence of the author, to explain the bill.  Senator Gallegos  
         sent up a committee substitute; the chair recognized Senator  
         Harris to explain the difference between the committee  
         substitute and the bill as filed.  Senator Gallegos moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Witnesses testifying and registering on the bill  
         are shown on the attached list. The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  
         Senator Duncan moved that CSSB 379 be left pending; without  
         objection, it was so ordered.   
          
         There being no further business, Senator Duncan moved that the  
         Committee stand recessed subject to the call of the chair.   
         Without objection, it was so ordered.   
          
         February 20, 2003 
         Upon adjournment of the Senate and following a suspension of the  
         24-hour posting rule, the Committee reconvened at Chairman  
         Duncan's desk on the Senate floor at 11:06 a.m.  With a quorum  
         present, Senator West requested unanimous consent to be shown  
         voting "aye" on SB 151, SB 164 and SB 375.  There being no  
         objection, it was so ordered.  There being no further business,  
         the Committee stood recessed subject to the call of the chair.
