         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Finance was  
         held on Monday, May 5, 2003, in the Capitol Extension, Room  
         E1.036, at Austin, Texas.

         The chair called the meeting to order at 8:15 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out SB 1370 and recognized the author, Senator  
         Duncan, to explain the bill.  Senator Duncan sent up a committee  
         substitute; the chair recognized Senator Duncan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Duncan moved adoption of the committee substitute;  
         without objection, it was so ordered.  Senator Bivins moved that  
         SB 1370 be left pending to await a quorum; without objection, it  
         was so ordered.  Upon arrival of a quorum, Senator Duncan moved  
         that SB 1370 do not pass but that CSSB 1370 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 9 ayes, 3  
         nays, 0 present not voting, and 3 absent.     
  
         The chair laid out SB 1369 and recognized the author, Senator  
         Duncan, to explain the bill.  Senator Duncan sent up a committee  
         substitute; the chair recognized Senator Duncan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Duncan moved adoption of the committee substitute;  
         without objection, it was so ordered.  Senator Bivins moved that  
         SB 1369 be left pending to await a quorum; without objection, it  
         was so ordered.  Upon arrival of a quorum, Senator Duncan moved  
         that SB 1369 do not pass but that CSSB 1369 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 9 ayes, 3  
         nays, 0 present not voting, and 3 absent.   
          
         The chair laid out SB 1742 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Zaffirini moved adoption of the committee substitute;  
         without objection, it was so ordered.  Senator Bivins moved that  
         SB 1742 be left pending to await a quorum; without objection, it  
         was so ordered.  Upon arrival of a quorum, Senator Zaffirini  
         moved that SB 1742 do not pass but that CSSB 1742 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 11 ayes, 0  
         nay, 0 present not voting, and 4 absent.  Senator Zaffirini  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 124 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator Shapleigh sent up a  
         committee substitute; the chair recognized Senator Shapleigh to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.   
          
         At 10:56 a.m. Senator Bivins moved that the committee stand  
         recessed until 30 minutes after adjournment of the Senate;  
         without objection, it was so ordered.   
          
         At 4:42 p.m. the committee reconvened.   
          
         Testimony continued on SB 124.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Bivins moved that SB 124 be left pending; without  
         objection, it was so ordered.       
          
         At 4:58 p.m. Senator Shapleigh assumed the chair.   
                                                                            
         The chair laid out SB 1861 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Shapleigh moved  
         that SB 1861 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum, Senator  
         Bivins moved that SB 1861 do not pass but that CSSB 1861 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of  
         10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator  
         Bivins moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The chair laid out SB 1867 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Without objection, the committee substitute for SB 1867  
         was adopted.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  The  
         chair moved that SB 1867 be left pending; without objection, it  
         was so ordered.   
         At 5:08 p.m. Senator Zaffirini assumed the chair.   
          
         At 5:19 p.m. Senator Bivins resumed the chair.   
          
         The chair laid out SB 1780 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Ogden sent up a committee  
         substitute; the chair recognized Senator Ogden to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Ogden moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Staples moved  
         that SB 1780 do not pass but that CSSB 1780 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 10 ayes, 0  
         nay, 0 present not voting, and 5 absent.   
          
         At 5:30 p.m. Senator Whitmire assumed the chair.   
          
         At 5:31 p.m. Senator Bivins resumed the chair.   
          
         The chair laid out SB 1592 and recognized Senator Zaffirini, in  
         the absence of the author, to explain the bill.  Senator  
         Zaffirini sent up a committee substitute; the chair recognized  
         Senator Zaffirini to explain the difference between the  
         committee substitute and the bill as filed.  Without objection  
         the committee substitute for SB 1592 was adopted.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Shapleigh moved  
         that SB 1592 do not pass but that CSSB 1592 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 2 present not voting, and 5 absent.   
          
         The chair laid out SB 823 that was left pending from a previous  
         hearing.  Senator Zaffirini sent up a committee substitute.   
         Senator Zaffirini moved adoption of the committee substitute;  
         without objection, it was so ordered.  Senator Bivins moved that  
         SB 823 be left pending; without objection, it was so ordered.     
          
         There being no further business, at 5:48 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
