         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Thursday, April 24, 2003, in the Capitol Extension, Room  
         E1.012, at Austin, Texas.

         The chair called the meeting to order at 8:35 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill(s): SB 671 
          
         The chair laid out SB 1357 and recognized the author, Senator  
         Nelson, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         The chair moved that SB 1357 be left pending to await a quorum;  
         without objection, it was so ordered.   
          
         The chair laid out HB 242 and recognized the Senate sponsor,  
         Senator Van de Putte, to explain the bill.

         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         The chair moved that HB 242 be left pending to await a quorum;

         Senator Shapiro, to explain the bill.

         The chair laid out SB 671 and recognized the author, Senator  
         Staples, to explain the bill.   
          
         Senator Staples sent up a committee substitute; the chair  
         recognized Senator Staples to explain the difference between the  
         committee substitute and the bill as filed.  Senator Staples  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         The subcommittee report on SB 1642 was laid out by Senator  
         Staples.  Senator Staples was recognized to explain the  
         subcommittee report on SB 1642.  Senator Staples then moved  
         adoption of the subcommittee report; there being no objection,  
         it was so ordered.   
          
         Senator Zaffirini moved that SB 1642 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
         The subcommittee report on HB 1055 was laid out by Senator  
         Shapiro.  Senator Shapiro was recognized to explain the  
         subcommittee report on HB 1055.  Senator Shapiro then moved  
         adoption of the subcommittee report; there being no objection,  
         it was so ordered.   
          
         Senator Zaffirini moved that HB 1055 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Zaffirini sent up a committee substitute to SB 1357,  
         having been previously laid out; the chair previously recognized  
         Senator Nelson to explain the difference between the committee  
         substitute and the bill as filed.  Senator Zaffirini moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.   
          
         Senator Zaffirini sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Zaffirini requested unanimous consent to roll the amendment into  
         the committee substitute; without objection, it was so ordered.   
         Senator Zaffirini then moved that the new committee substitute  
                                                                            
         be adopted; without objection, it was so ordered.   
          
         Senator Zaffirini moved that SB 1357 do not pass but that CSSB  
         1357 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator West moved that HB 242 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.   
          
         Senator West moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         Senator Williams sent up Committee Amendment 1 to HB 1022,  
         having previously been laid out, and moved adoption; without  
         objection, the amendment was adopted.   
          
         The chair moved that the committee stand at ease at 10:18 a.m.  
         without objection; it was so ordered.  At 10:30 a.m. the  
         committee came back to order.   
          
         Senator Williams moved that HB 1022, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 9 ayes, 0  
         nay, 0 present not voting, and 0 absent.   
          
         Senator Staples moved that SB 671 do not pass but that CSSB 671  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 9 ayes, 0 nay, 0 present not voting, and 0 absent.   
          
         Senator Staples moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered. 
          
         At 10:33 a.m. Senator West assumed the chair.   
          
         Upon arrival of a quorum, Senator Shapiro moved that HB 319 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         Senator Shapiro moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         Senator Staples moved to reconsider the motion by which CSSB 671  
         was placed on the Local and Uncontested Calender; without  
   
                                                                            
         objection, it was so ordered. 
          
         Upon arrival of a quorum, Senator Shapiro moved that HB 1295 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   
         Senator Shapiro moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         At 10:38 a.m. Senator Shapiro resumed the chair.   
          
         There being no further business, at 10:39 a.m. Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
