         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Thursday, April 3, 2003, in the Capitol Extension, Room  
         E1.012, at Austin, Texas.

         The chair called the meeting to order at 8:37 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator West moved adoption of the minutes from the previous  
         hearing held on April 1, 2003; without objection, it was so  
         ordered.   
          
         There was no action taken for the following bill(s): SB 933, SB  
         1096, and SB 1510 
          
         The chair laid out SB 251 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.   
          
         Senator Ogden sent up a committee substitute; the chair  
         recognized Senator Lucio, Jr. to explain the difference between  
         the committee substitute and the bill as filed.  Senator Ogden  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
         Senator West moved that SB 251 do not pass but that CSSB 251 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 7  
  
         ayes, 0 nay, 0 present not voting, and 2 absent.  
          
         The chair laid out SB 1624 and recognized the author, Senator  
         Bivins, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         Senator Ogden moved that SB 1624 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.   
          
         Senator Van de Putte moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The chair laid out SB 1359 and recognized the author, Senator  
         Lindsay, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         The chair moved that SB 1359 be left pending; without objection,  
         it was so ordered.   
          
         The chair laid out SB 1488 and recognized the author, Senator  
         Ogden, to explain the bill.   
          
         Senator Ogden sent up a committee substitute; the chair  
         recognized Senator Ogden to explain the difference between the  
         committee substitute and the bill as filed.  Senator Ogden moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.   
          
         Senator Ogden sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Ogden  
         requested unanimous consent to incorporate the  amendment into  
         the committee substitute; without objection, it was so ordered.   
         Senator Ogden then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         The chair moved that SB 1488 be left pending to await a quorum;  
         without objection, it was so ordered.   
          
         At 9:39 a.m. Senator Ogden assumed the chair.   
          
         The chair laid out SB 1109 and recognized the author, Senator  
         Shapiro, to explain the bill.   
  
         Senator Shapiro sent up a committee substitute; the chair  
         recognized Senator Shapiro to explain the difference between the  
         committee substitute and the bill as filed.  Senator Shapiro  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.   
          
         Senator Shapiro sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Shapiro requested unanimous consent to incorporate the amendment  
         into the committee substitute; without objection, it was so  
         ordered.  Senator Shapiro then moved that the new committee  
         substitute be adopted; without objection, it was so ordered.

         closed; without objection, it was so ordered.   
          
         Senator Ogden moved that SB 1109 be left pending to await a  
         quorum; without objection, it was so ordered.   
          
         The chair laid out SB 1373 and recognized the author, Senator  
         Shapiro, to explain the bill.   
          
         Senator Shapiro sent up a committee substitute; the chair  
         recognized Senator Shapiro to explain the difference between the  
         committee substitute and the bill as filed.  Senator Shapiro  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.

         closed; without objection, it was so ordered.   
          
         Senator Shapiro moved that SB 1373 do not pass but that CSSB  
         1373 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         Senator Shapiro moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         Upon arrival of a quorum, Senator West moved that SB 1109 do not  
         pass but that CSSB 1109 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         At 9:55 a.m. Senator Shapiro resumed the chair.   
          
         Upon arrival of a quorum, Senator Ogden moved that SB 1488 do  
         not pass but that CSSB 1488 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not                                                                            
         voting, and 1 absent.   
          
         There being no further business, at 9:56 a.m. the chair moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
