         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Business &  
         Commerce was held on Tuesday, March 11, 2003, in the Betty King  
         Committee Hearing Room, 2E.20, at Austin, Texas.

         Chairman Fraser called the meeting to order at 9:10 a.m.  There  
         being a quorum present, the following business was transacted:   
          
         The Chairman laid out SB 417 and SJR 22, pending in committee,  
         and recognized the author, Senator Harris.  Senator Williams  
         sent up the committee substitute to SB 417 and Senator Harris  
         explained the difference between the committee substitute and  
         the bill as filed.  Senator Williams moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Senator Williams moved that SB 417 do not pass but that CSSB 417  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator  
         Lucio moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         Senator Lucio moved that SJR 22 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 9 ayes, 0 nay, 0  
         present not voting, and 0 absent.   
          
         The Chairman advised that he would lay out SB 91, SB 99 and SB  
  
         130 together, and recognized the author of SB 91, Senator West,  
         to explain the bill.  Senator Fraser explained SB 99 in the  
         absence of the author, Senator Van de Putte.  Senator Jackson  
         then assumed the chair, and recognized Senator Fraser, the  
         author of SB 130, to explain the bill. 
          
         The Chairman then called the following invited witnesses to  
         testify on the credit scoring report, A Statistical Analysis of  
         the Relationship Between Credit History and Insurance Losses,  
         which was prepared by the Bureau of Business Research, McCombs  
         School of Business, The University of Texas at Austin: 
          
              Dr. Bruce Kellison, Bureau of Business Research, University  
         of Texas, 
              Dr. Patrick Brockett, Bureau of Business Research,  
         University of Texas, and 
              Jeffrey Skelton, Choice Point, Alpharetta, Georgia. 
          
         The Chairman read Motions in Writing submitted by Senator  
         Armbrister, Senator Brimer, Senator Averitt and Senator Van de  
         Putte  requesting unanimous consent to be shown voting aye on  
         CSSB 417 and SJR 22. Without objection, it was so ordered. 
          
         At 10:50 a.m. the Chairman moved that the committee stand  
         recessed until 15 minutes after adjournment of the Senate;  
         without objection, it was so ordered.   
          
         At 1:05 p.m. the committee reconvened with Senator Averitt in  
         the chair.  Dr. Kellison, Dr. Brockett and Jeffrey Skelton were  
         recalled for further testimony and to respond to members'  
         questions.  Wayne Harrell, representing Wayne Harrell Insurance  
         Agency, Fredericksburg, testified in favor of SB 130.  The  
         Chairman closed public testimony on SB 130.  Public testimony on  
         SB 91 and SB 99 was then heard.  Witnesses registering and  
         testifying on the bills are shown on the attached list.  At 3:15  
         p.m. Senator Brimer assumed the chair. 
          
         Upon completion of testimony, the Chairman advised that SB 91,  
         SB 99 and SB 130 would be left pending.  Without objection, it  
         was so ordered. 
          
         There being no further business, at 3:32 p.m. the Chairman moved  
         that the Committee stand recessed subject to the call of the  
         chairman.  Without objection, it was so ordered.
