         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Business &  
         Commerce was held on Thursday, February 13, 2003, in the Betty  
         King Committee Hearing Room, 2E.20, at Austin, Texas.

         Chairman Fraser called the meeting to order at 9:00 a.m.  There  
         being a quorum present, the following business was transacted:   
          
         The Chairman laid out SB 14, which was pending in Committee, and  
         called the first invited witness, Chris McClellan, representing  
         Texas County Mutual Association, Austin. 
          
         At 9:20 a.m. Senator Averitt assumed the chair, and Chris  
         McClellan's testimony continued.  Upon conclusion of Mr.  
         McClellan's testimony, the Chairman called the next witness,  
         Lyndell Haigood, representing Beacon Insurance Group, Wichita  
         Falls. 
          
         At 9:55 a.m. the Chairman moved that the Committee stand  
         recessed until 15 minutes after adjournment of the Senate;  
         without objection, it was so ordered. 
          
         At 10:58 a.m. the committee reconvened, with invited testimony  
         on SB 14 continuing.  Chairman Fraser called the following  
         witnesses: 
              Dan Lambe, Texas Watch, Austin, 
              Jose Montemayor, Commissioner, Texas Department of  
         Insurance, and 
              Philip Presley, Texas Department of Insurance. 
  
         The Chairman then recalled Lyndell Haigood, to complete his  
         testimony and respond to members' questions. 
          
         Following Mr. Haigood's testimony, the Chairman called David Van  
         Delinder, representing the Independent Insurance Agents of  
         Texas, Austin, to present his testimony. 
          
         Upon completion of invited testimony, Chairman Fraser moved that  
         SB 14 be left pending;  without objection, it was so ordered. 
          
         There being no further business, at 12:52 p.m. Chairman Fraser  
         moved that the Committee stand recessed subject to the call of  
         the chairman.  Without objection, it was so ordered.
