         Pursuant to a notice posted on January 16, 2004, the House  
         Committee on Public Health met in a public hearing and was  
         called to order by the chair, Representative Capelo, at 11:14  
         a.m. 
          
         The roll was answered as follows: 
          
         Present:  Representatives Capelo; Truitt; Dawson; McReynolds;  
                   Naishtat (5). 
          
         Absent:   Representatives Laubenberg; Coleman; Taylor; Zedler  
                   (4). 
          
         A quorum was present. 
          
         Chairman Capelo reviewed the Interim Charges 
          
         (Representative Coleman now present.) 
          
         The Committee heard invited testimony from Susan Tennyson from  
         the Texas Department of Health regarding the Federal Drug  
         Administration's recent ban of products containing Ephedra. 
          
         At 11:57 a.m., on the motion of the chair and without objection,  
         the meeting was recessed subject to the call of the chair.
