         Pursuant to a notice posted on October 18, 2004, the House  
         Committee on Insurance met in a public hearing and was called to  
         order by the chair, Representative Smithee, at 10:13 a.m.  The  
         committee met jointly with the Senate Committee on Business and  
         Commerce and the Property and Casualty Legislative Oversight  
         Committee. 
          
         The roll was answered as follows: 
          
         Present:  Representatives Smithee; Seaman; Eiland; Taylor (4). 
          
         Absent:   Representatives Bonnen; Gallego; Keffer, Bill;  
                   Thompson; Van Arsdale (5). 
          
         A quorum was not present. 
          
         The committee heard invited testimony from Jose Montemayor,  
         Commissioner for the Texas Department of Insurance. 
          
         (Representative Gallego now present.) 
          
         A quorum was present. 
          
         The committee heard testimony from Rod Bordelon, Public Counsel  
         for the Office of Public Insurance Counsel. 
          
         Public testimony was taken. 
          
         At 12:58 p.m., on the motion of the chair and without objection,  
         the meeting was recessed subject to the call of the chair.
