Amend CSHB 3015 as follows:
(1) On page 2, between lines 16 and 17, insert the following:
(e) Notwithstanding the other provisions of this section, the
governing board of an institution of higher education may not
charge a nonresident student tuition under this section in an
amount that exceeds an amount computed by multiplying the tuition
charged to a similarly situated resident student under this section
in the same academic year by a fraction, the numerator of which is
the tuition that would have been charged to a similarly situated
nonresident student in the 2002-2003 academic year and the
denominator of which is the tuition that would have been charged to
a similarly situated resident student in the 2002-2003 academic
year. For purposes of this subsection, a student is similarly
situated to the nonresident student for whom the maximum tuition is
being computed if the factors affecting the tuition that would be
charged to those students, other than Texas residency status, are
the same, including the degree program in which the students are
enrolled, whether the students are enrolled in a regular semester
or summer term, and the course load for which the students are
enrolled.
(2) Beginning on page 2, line 17, reletter the other
subsections of amended Section 54.0513, Education Code,
accordingly.
