         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Health and  
         Human Services was held on Thursday, February 22, 2001, in the  
         Senate Chamber at Austin, Texas.

         The chairman called the meeting to order at 9 a.m.  There being  
         a quorum present, the following business was transacted. 
          
         The chairman laid out the February 15, 2001, minutes and called  
         for revisions.  There being none, Senator Harris moved their  
         approval.  There being no objection, the motion prevailed by  
         unanimous consent. 
          
         The chairman laid out SB 48 by Senator Zaffirini, relating to  
         sanctions imposed on recipients of temporary assistance for  
         needy families for failure to provide certain information, and  
         recognized the author to explain the bill. 
          
         Witnesses testifying and registering on SB 48 are shown on the  
         attached list.  There being no other witnesses registered or  
         responding to the chairman's call for public testimony on SB 48,  
         the chairman closed public testimony. 
          
         Senators Bernsen, Madla, Shapleigh and Sibley asked unanimous  
         consent to be shown voting "aye" on SB 48.  There being no  
         objection, the motion prevailed by unanimous consent.    
          
         Senator Nelson moved that SB 48 be reported to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         prevailed by a vote of  8 ayes, 0 nays and 1 absent. 
         The chairman laid out SB 49 by Senator Zaffirini, relating to  
  
         applying penalties to recipients of financial and nutritional  
         assistance for certain drug-and-alcohol-related convictions, and  
         recognized the author to explain the bill. 
          
         Senator Harris sent up a committee substitute for SB 49 and  
         Senator Zaffirini explained the differences between it and the  
         bill as filed. 
          
         Senator Harris moved the adoption of the committee substitute  
         for SB 49.  There being no objection, the motion prevailed by  
         unanimous consent. 
          
         Witnesses testifying and registering on the committee substitute  
         for SB 49 are shown on the attached list.  There being no other  
         witnesses registered or responding to the chairman's call for  
         public testimony relating to the committee substitute for SB 49,  
         the chairman closed public testimony. 
          
         At the chairman's request, the committee substitute for SB 49  
         was left pending. 
          
         The chairman laid out SB 53 by Senator Zaffirini, relating to  
         access to criminal history record information by the Department  
         of Protective ad Regulatory Services, and recognized the author  
         to explain the bill. 
          
         Senator Nelson sent up a committee substitute for SB 53 and  
         Senator Zaffirini explained the differences between it and the  
         bill as filed. 
          
         Senator Nelson moved the adoption of the committee substitute  
         for SB 53.  There being no objection, the motion prevailed by  
         unanimous consent.

         witnesses registered or responding to the chairman's call for  
         public testimony relating to the committee substitute for SB 53,

         motion prevailed by a vote of 8 ayes, 0 nays and 1 absent. 
          
         The chairman laid out SB 583 by Senator Duncan, relating to  
         liens for certain services provided by physicians, and  
         recognized the author to explain the bill. 
          
         Senator Nelson sent up a committee substitute for SB 583 and  
  
         Senator Duncan explained the differences between it and the bill  
         as filed. 
          
         Senator Nelson moved the adoption of the committee substitute  
         for SB 583.  There being no objection, the motion prevailed by  
         unanimous consent.

         witnesses registered or responding to the chairman's call for

         Senator Nelson moved that SB 583 be reported to the Senate with  
         the recommendation that it do not pass, but that the committee  
         substitute adopted in lieu thereof do pass and be printed.  The  
         motion prevailed by a vote of 7 ayes, 0 nays and 2 absent. 
          
         The chairman laid out anew SB 285 by Senator Nelson, relating to  
         cancer incidence reporting, which had been left pending, and  
         recognized the author. 
          
         Senators Carona and Shapleigh asked unanimous consent to be  
         shown voting "aye" on SB 285. There being no objection, the  
         motion prevailed by unanimous consent.   
          
         Senator Nelson moved that SB 285 be reported to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         prevailed by a vote of 5 ayes, 0 nays and 4 absent. 
          
         Senator Nelson moved that SB 285 be recommended for  
         certification on the local and uncontested calendar.  There  
         being no objection, the motion prevailed by unanimous consent. 
         At 9:33 a.m. Senator Nelson assumed presiding duties. 
          
         The chairman laid out SB 572 by Senator Moncrief, relating to  
         reduction of the shortage of registered nurses by establishing a  
         program to increase enrollments in nursing education programs,  
         increasing nursing faculty, and creating a nursing workforce  
         data center, and recognized the author to explain the bill. 
          
         Senator Moncrief sent up a committee substitute for SB 572 and  
         explained the differences between it and the bill as filed. 
          
         Senator Moncrief moved the adoption of the committee substitute  
         for SB 572.  There being no objection, the motion prevailed by  
         unanimous consent.

         for SB 572 are shown on the attached list.  There being no other  
  
         witnesses registered or responding to the chairman's call for  
         public testimony relating to the committee substitute for SB

         The chairman laid out SB 558 by Senator Madla, relating to an  
         advisory committee to reducing drug abuse, and recognized  
         Senator Moncrief, in absence of the author, to explain the bill. 
          
         Senator Moncrief sent up a committee substitute for SB 558 and  
         explained the differences between it and the bill as filed. 
          
         Senator Moncrief moved the adoption of the committee substitute  
         for SB 558.  There being no objection, the motion prevailed by  
         unanimous consent.

         for SB 558 are shown on the attached list.  There being no other  
         witnesses registered or responding to the chairman's call for  
         public testimony on the committee substitute for SB 558, the

         Senator Moncrief moved that SB 558 be reported to the Senate  
         with the recommendation that it do not pass, but that the  
         committee substitute adopted in lieu thereof do pass and be  
         printed.  The motion prevailed by a vote of 7 ayes, 0 nays and 2  
         absent. 
          
         Senator Moncrief moved that the committee substitute for SB 558  
         be recommended for certification on the local and uncontested  
         calendar.  There being no objection, the motion prevailed by  
         unanimous consent. 
          
         At 9:53 a.m. Senator Moncrief resumed presiding duties. 
          
         The chairman laid out SB 22 by Senator Shapiro, relating to the  
         admission of minors to facilities for and to the consent of  
         minors to the treatment and rehabilitation of chemical  
         dependency, and recognized the author to explain the bill. 
          
         Testimony on SB 22 began. 
          
         By unanimous consent, the chairman recessed the committee at  
         10:40 a.m. until 30 minutes after the adjournment of the Texas  
         Senate. 
          
         The chairman reconvened the Senate Committee on Health and Human  
         Services at 1 p.m. 
  
         The chairman laid out SB 415 by Senator Carona, relating to  
         operation of the Texas Medical Liability Insurance Underwriting  
         Association and to participation of nursing homes in that  
         association, and recognized the author to explain the bill. 
          
         Senator Carona sent up a committee substitute for SB 415 and  
         explained the differences between it and the bill as filed. 
          
         Senator Carona moved the adoption of the committee substitute  
         for SB 415.  There being no objection, the motion prevailed by  
         unanimous consent.

         for SB 415 are shown on the attached list.  There being no other  
         witnesses registered or responding to the chairman's call for

         printed.  The motion prevailed by a vote of 7 ayes, 0 nays and 2  
         absent. 
          
         The chairman laid out anew, SB 22 by Senator Shapiro, relating
