         Pursuant to suspension of Senate Rule 11.18, a public hearing of  
         the Senate Committee on Criminal Justice was held on Thursday,  
         April 19, 2001, in the Senate Chamber at Austin, Texas.

         Senator Kenneth Armbrister              None 
         Senator John Whitmire 
         Senator Teel Bivins 
         Senator Mike Moncrief 
         Senator Steve Ogden 
         Senator Todd Staples

         The chair called the meeting to order at 3:00 p.m.  There being  
         a quorum present, the following business was transacted: 
          
         Senator West moved to reconsider the vote by which SB85 failed.   
         Senator Ogden objected to the motion to reconsider the vote.   
         The chair called for a record vote.  The motion carried with a  
         record vote of 4 ayes, 3 nays, 0 present not voting and 0  
         absent.  The committee substitute for SB85 had previously been  
         adopted.  Senator West moved that SB85 do not pass but that  
         CSSB85 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 4 ayes, 3 nays, 0 present not voting, and 0  
         absent.   
          
         The chair brought up SB1582 from pending business.  The  
         committee substitute for SB1582 had previously been adopted.   
         Senator Moncrief moved that SB1582 do not pass but that CSSB1582  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         There being no further business, at 3:05 p.m. Senator Armbrister  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
