         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Tuesday, April 17, 2001, in the Senate  
         Chamber, at Austin, Texas.

         The Chair called the meeting to order at 3:48 p.m.  There being  
         a quorum present, the following business was transacted: 
          
         The Chair laid out SB1802 and recognized the author, Senator  
         Truan, to explain the bill.  Public testimony was closed.  The  
         bill was left pending awaiting a quorum. 
          
         Senator Bivins assumed the Chair. 
          
         The Chair laid out SB1331 and recognized the author, Senator  
         Brown, to explain the bill.  Senator Brown sent up a committee  
         substitute; the Chair recognized Senator Brown to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Brown moved adoption of the committee  
         substitute; without objection, it was so ordered.  Public  
         testimony was taken.  Witnesses testifying and registering on  
         the bill are shown on the attached list.  The bill was left  
         pending awaiting a quorum. 
          
         The Chair laid out SB1333 and recognized the author, Senator  
         Brown, to explain the bill.  Public testimony was closed.  The  
         bill was left pending awaiting a quorum.   
          
         The Chair laid out SB1494 and recognized the author, Senator  
         Brown, to explain the bill.  Public testimony was taken.

         The Chair laid out HB1027 and recognized the Senate sponsor,  
         Senator Brown, to explain the bill.  Public testimony was

         Senator Brown resumed the Chair. 
          
         The Chair laid out SB1036 and recognized Senator Bivins to  
         explain the bill for the author, Senator Zaffirini.  Public  
         testimony was closed.  The bill was left pending awaiting a  
         quorum. 
          
         The Chair laid out SB1758 and recognized Senator Bivins to  
         explain the bill for the author, Senator Zaffirini.  Public  
         testimony was taken.  Witnesses registering and testifying on  
         the bill are shown on the attached list.  Public testimony was  
         closed.  The bill was left pending awaiting a quorum. 
          
         The Chair laid out SB312 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins  to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Public  
         testimony was taken.  Witnesses registering and testifying on  
         the bill are shown on the attached list.  Public testimony was  
         closed.  Senator Lucio sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Lucio asked unanimous consent to incorporate the amendment  into  
         the committee substitute; without objection, it was so ordered.

         The Chair laid out HB906 and recognized the Senate sponsor,  
         Senator Lucio, to explain the bill.  Senator Lucio sent up  
         Committee Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Public testimony was closed.  The bill  
         was left pending awaiting a quorum.   
          
         The Chair laid out SB372 and recognized Senator Lucio to explain  
         the bill for the author, Senator Madla.  Public testimony was  
         closed.  The bill was left pending awaiting a quorum.   
          
         The Chair laid out SB1541, left pending from a previous hearing,  
         and recognized the author, Senator Duncan, to explain the bill.   
         Senator  Duncan sent up a committee substitute; the Chair  
         recognized Senator Duncan to explain the difference between the  
  
         committee substitute and the bill as filed.  Senator Bivins sent  
         up Committee Amendment 1 and moved adoption.  The amendment was  
         adopted with a record vote of 3 ayes, 1 nay, 3 absent, and 0  
         present not voting.  Senator Duncan moved that SB1541 not pass,  
         but that CSSB1541 be reported back to the Senate with the  
         recommendation it do pass and be printed.  The motion carried  
         with a record vote of 5 ayes, 0 nays, 0 present not voting, and  
         2 absent.   
          
         The Chair laid out SB910 and recognized the author Senator  
         Shapiro to explain the bill.  Senator Bivins sent up a committee  
         substitute and moved its adoption; without objection, it was so  
         adopted.  Senator Shapiro was recognized to explain the  
         difference between the committee substitute and the bill as  
         filed.  Public testimony was taken.  Witnesses registering and  
         testifying on the bill are shown on the attached list.  Public  
         testimony was closed.  The bill was left pending awaiting a  
         quorum.   
          
         At 5:45 p.m., the Committee stood at ease until 6:00 p.m. 
          
         The Committee came back to order at 6:05 p.m. 
          
         Senator Bivins moved that SB1331 not pass but that CSSB1331 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nays, 2 absent, and 0 present not voting.  Senator  
         Bivins moved that the bill be recommended for placement in the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered. 
          
         Senator Bivins moved that SB1333 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of  5 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Bivins moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered. 
          
         Senator Bivins moved that SB1494 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         Senator Bivins moved that HB1027 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Lucio moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered. 
          
         Senator Lucio  moved that SB1036 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Lucio moved that the  
         bill be recommended for placement on the Local & Uncontested  
  
         Calendar; without objection, it was so ordered. 
         Senator Lucio  moved that SB1758 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 0 nays, 0  
         present not voting, and 2 absent.  Senator Lucio moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered. 
          
         Senator Bivins moved that SB312 not pass but that CSSB312 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 5 ayes, 0 nays, 0 present not voting, and 2 absent.  
          
         Senator Lucio moved that HB906 as amended pass and be reported  
         favorably back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nays, 0 present not voting, and 2 absent.  
          
         Senator Lucio moved that HB372  be reported favorably back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nays, 0 present not voting, and 2 absent.   Senator Lucio moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Lucio moved that SB910 not pass but that CSSB910 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of   
         5 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator  
         Lucio moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered. 
          
         Senator Bivins moved adoption of the Minutes from the previous  
         hearing held on April 10, 2001; without objection, it was so  
         ordered. 
          
         There being no further business, at 6:13 p.m. the Committee  
         stood recessed subject to the call of the Chair.  Without
