         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Thursday, April 5, 2001, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 2:12 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Lucio moved adoption of the Minutes from the previous  
         hearing held on March 29, 2001; without objection, it was so  
         ordered.   
          
         SB 1541 had no action taken at the request of the author. 
          
         The Chair laid out SB1339 as amended, left pending from a  
         previous hearing, and recognized Senator Brown, in the absence  
         of the author, Senator Ogden, to explain the bill.  Senator  
         Duncan moved that SB1339 as amended be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 4 ayes, 3 nays, 0  
         present not voting, and 0 absent.   
          
         The Chair laid out CSSB2 as amended and recognized the author,  
  
         Senator Brown, to explain the bill. Testimony was taken.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   Senator Brown sent up Committee Amendment 2  
         and Senator Lucio moved adoption; without objection, the  
         amendment was adopted.  Senator Brown sent up Committee  
         Amendment 3 and Senator Lucio moved adoption; without objection,  
         the amendment was adopted.  Senator Brown sent up Committee  
         Amendment 4 and moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 5 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 6 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Brown sent up Committee Amendment 7 and moved adoption;  
         without objection, the amendment was adopted.  Senator Brown  
         sent up Committee Amendment 8 and Senator Lucio moved adoption;  
         without objection, the amendment was adopted.  Senator Brown

         Committee Amendment 24.  Senator Brown sent up Committee  
         Amendment 25.  Senator Brown then pulled down Committee  
         Amendment 25.  Senator Brown sent up Committee Amendment 26 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 27 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 28 and  
         Senator Lucio moved adoption; without objection, the amendment  
  
         was adopted.  Senator Brown sent up Committee Amendment 29 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 30 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 31 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 32 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 33 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 34 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 35 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 36 and  
         Senator Lucio moved adoption; without objection, the amendment  
         was adopted.  Senator Brown sent up Committee Amendment 37.   
         Senator Brown then pulled down Committee Amendment 37.  Senator  
         Brown sent up Committee Amendment 38 and Senator Lucio moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Brown sent up Committee Amendment 39.  Senator Brown then pulled  
         down Committee Amendment 39.  Senator Brown sent up Committee  
         Amendment 40 and Senator Lucio moved adoption; without  
         objection, the amendment was adopted.  Senator Brown sent up  
         Committee Amendment 41 and Senator Lucio moved adoption; without  
         objection, the amendment was adopted.  Senator Lucio sent up  
         Committee Amendment 43 and Senator Brown moved adoption; without  
         objection, the amendment was adopted.  Senator Lucio sent up  
         Committee Amendment 44.  Senator Lucio then pulled down  
         Committee Amendment 44.   
          
         Senator Lucio assumed the Chair.  Senator Duncan sent up  
         Committee Amendment 45.  Senator Duncan then pulled down  
         Committee Amendment 45.  Senator Bivins sent up Committee  
         Amendment 46 and moved adoption; without objection, the  
         amendment was adopted.  Senator Bivins sent up Committee  
         Amendment 47.  Senator Bivins sent up an amendment to amendment  
         47 and moved adoption; without objection, Committee Amendment 47  
         as amended was adopted.  Senator Bivins sent up Committee  
         Amendment 48 and moved adoption; without objection, it was  
         adopted.  Senator Brown moved adoption of Committee Amendment  
         24; without objection, it was adopted.  Senator Lucio moved  
         adoption of Committee Amendment 25; without objection, it was  
         adopted.  Senator Brown requested unanimous consent to  
         incorporate amendments into a new committee substitute; without  
         objection, it was so ordered.  Senator Brown then moved that the  
         new committee substitute be adopted; without objection, it was  
         so ordered.  Senator Brown moved that SB2 do not pass but that  
         CSSB2 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 5 ayes, 0 nay, 0 present not voting, and 2  
         absent.   
          
         There being no further business, at 4:37 p.m. the Committee  
         stood recessed subject to the call of the Chair.  Without  
  
         objection, it was so ordered.
