         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Tuesday, February 27, 2001, in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 2:05 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Bernsen moved adoption of the minutes from the previous  
         hearing held on February 20, 2001; without objection, it was so  
         ordered.   
          
         A presentation was given by David Duncan, an attorney at the  
         TNRCC, on the U.S. Supreme Court rulings on the lawsuits  
         regarding the EPA and the American Trucking Association.   
          
         The Chair laid out SB571 and recognized the author, Senator  
         Lucio, to explain the bill.   Senator Lucio sent up a committee  
         substitute; the Chair recognized Senator Lucio to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Lucio moved adoption of the committee  
         substitute; without objection, it was so ordered. Public  
         testimony was taken.  Witnesses testifying and registering on  
  
         the bill are shown on the attached list.  The Chair then closed  
         public testimony.  Senator Lucio moved that CSSB571 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The Chair laid out SB716 and recognized the author, Senator  
         Duncan, to explain the bill.  Senator Duncan sent up a committee  
         substitute; the Chair recognized Senator Duncan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Duncan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Public  
         testimony was taken.  Witnesses testifying and registering on  
         the bill are shown on the attached list.  The Chair closed  
         public testimony.  Senator Duncan moved that CSSB716 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Duncan  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Duncan moved that CSSB571 be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered. 
          
         At 3:10 p.m. Senator Duncan assumed the Chair.   
          
         The Chair laid out SB352 and recognized the author, Senator  
         Truan, to explain the bill.  Public testimony was taken.

         At 3:20 p.m. Senator Brown resumed the Chair. The Chair then  
         closed public testimony.  Senator Bernsen moved that SB352 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 1 absent.   Senator  
         Bernsen moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The Chair laid out SB717 and recognized the author, Senator  
         Duncan, to explain the bill.  Public testimony was taken.   
         Witnesses testifying and registering on the bill are shown on

         Duncan moved that SB717 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion

         Lindsay, to explain the bill.  Senator Duncan sent up a  
         committee substitute; the Chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Duncan moved adoption of the committee  
         substitute; without objection, it was so ordered. Public

         testimony.  Senator Duncan moved that CSSB270 be reported  
         favorably to the Senate with the recommendation that it do pass

         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB331 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Haywood sent up a  
         committee substitute; the Chair recognized Senator Haywood to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Haywood moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Haywood moved that CSSB331 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 5 ayes, 0 nay, 0 present  
         not voting, and 2 absent.  Senator Haywood moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         At 3:50 p.m. Senator Duncan assumed the Chair.   
          
         The Chair laid out CSSB687 and recognized the author, Senator  
         Brown, to explain the bill.  Senator Brown sent up a new  
         committee substitute; the Chair recognized Senator Brown to  
         explain the difference between the new committee substitute and  
         the previous committee substitute.  Senator Brown moved adoption  
         of the new committee substitute; without objection, it was so  
         ordered.  Witnesses registering on the bill are shown on the  
         attached list.  The Chair then closed public testimony.  
          
         Senator Brown resumed the chair.  Senator Duncan moved that  
         CSSB687 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Duncan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.      
          
          There being no further business, at 4:00 p.m. the Committee  
         recessed subject to the call of the Chair.  Without objection,
