         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on State Affairs  
         was held on Monday, April 23, 2001, in the Senate Chamber at  
         Austin, Texas.

         Having recessed at the previous meeting the chair called the  
         meeting to order at 1:39 p.m. 
          
         There was no action taken for the following bill(s): SB488,  
         SB1068, and SB1124 
          
         The chair laid out SB1720 and recognized the author, Senator  
         Cain, to explain the bill.   
          
         Senator Armbrister sent up a committee substitute; the chair  
         recognized Senator Cain to explain the difference between the  
         committee substitute and the bill as filed.  Senator Armbrister  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         Senator Shapiro moved that SB1720 be left pending to await a  
         quorum; without objection, it was so ordered.

         without objection, the amendment was adopted.  Senator  
         Armbrister sent up Committee Amendment 3 and moved adoption;  
         without objection, the amendment was adopted.  Senator  
         Armbrister sent up Committee Amendment 4 and moved adoption;  
         without objection, the amendment was adopted.   
          
         At 5:44 p.m. Senator Armbrister resumed the chair.   
          
         Senator Madla sent up Committee Amendment 5 and moved adoption;  
         without objection, the amendment was adopted.

         Senator Madla requested unanimous consent to incorporate  
         amendments into the committee substitute; without objection, it

         substitute be adopted; without objection, it was so ordered.

         At 5:45 p.m. roll was called and a quorum was present. 
          
         Senator Armbrister moved adoption of the minutes from the  
         previous hearing held on April 17, 2001; without objection, it  
         was so ordered.   
          
         Senator Madla moved that SB1458 do not pass but that CSSB1458 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 3 absent.   
          
         Upon arrival of a quorum, Senator Armbrister moved that SB1720  
         do not pass but that CSSB1720 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 6 ayes, 0 nay, 0 present  
         not voting, and 3 absent.  Senator Armbrister moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Upon arrival of a quorum, Senator Armbrister moved that HB1679  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator  
         Armbrister moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
         Upon arrival of a quorum, Senator Armbrister moved that HB1737  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator  
         Armbrister moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         At 5:50 p.m. Senator Armbrister resumed the chair.   
          
         Senator Shapiro sent up Committee Amendment 1 to SB313 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Shapiro requested unanimous consent to roll the amendments into  
         a committee substitute; without objection, it was so ordered.   
         Senator Shapiro then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  
          
         At 5:52 p.m. Senator Shapiro resumed the chair.   
          
         Upon arrival of a quorum, Senator Fraser moved that SB313 do not  
  
         pass but that CSSB313 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 3 absent.   
          
         There being no further business, at 5:55 p.m. Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
