Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on State Affairs
was held on Thursday, March 22, 2001, in the Capitol Extension,
Room E1.028, at Austin, Texas.

The chair called the meeting to order at 1:40 p.m. There being
a quorum present, the following business was transacted:
Senator Truan moved adoption of the minutes from the previous
hearing held on March 19, 2001; without objection, it was so
ordered.
There was no action taken for the following bill(s): SB70
The chair laid out SB839 and recognized the author, Senator
Wentworth, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Shapiro moved that SB839 be left pending to await a
quorum; without objection, it was so ordered.
At 1:49 p.m. Senator Truan assumed the chair.
The chair laid out SB713 and recognized the author, Senator
Shapiro, to explain the bill.
Senator Shapiro sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
Shapiro sent up Committee Amendment 2 and moved adoption;
without objection, the amendment was adopted. Senator Shapiro
sent up Committee Amendment 3 and moved adoption; without
objection, the amendment was adopted. Senator Shapiro requested
unanimous consent to roll the amendments into a committee
substitute; without objection, it was so ordered. Senator
Shapiro then moved that the committee substitute be adopted;
without objection, it was so ordered.

Senator Shapiro moved that SB713 do not pass but that CSSB713 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 7
ayes, 0 nay, 0 present not voting, and 2 absent.
Senator Shapiro moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 1:56 p.m. Senator Shapiro resumed the chair.
Upon arrival of a quorum, Senator Carona moved that SB839 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 7
ayes, 0 nay, 0 present not voting, and 2 absent.
Senator Carona moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
Previously SB249 was left pending, Senator Fraser sent up the
committee substitute and Senator Lucio, Jr. explained the
difference between the committee substitute and the bill as
filed. Senator Shapiro moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Carona moved that SB249 do not pass but that CSSB249 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 6 ayes, 1
nay, 0 present not voting, and 2 absent.
Previously SB302 was left pending, Senator Shapleigh sent up the
committee substitute and moved its adoption; without objection
it was so ordered. Senator Shapleigh, in the absence of the
author, explained the difference between the committee
substitute and the bill as filed. Senator Armbrister moved that
SB302 do not pass but that CSSB302 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 2 absent.
Senator Shapleigh moved that the bill be recommended for

moved that SB485 be reported favorably to the Senate with the

Committee Amendment 1, and moved its adoption; without

Senate with the recommendation that it do pass and be printed.

Committee Amendment 1, and Senator Jackson was recognized to
explained the amendment. Senator Armbrister moved adoption;
without objection, the amendment was adopted. Senator
Armbrister moved that SB757, as amended, be reported back to the
Senate with the recommendation that it do pass and be printed.

present not voting, and 2 absent.
There being no further business, at 2:24 p.m. Senator Shapiro
moved that the Committee stand recessed subject to the call of
