         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Jurisprudence  
         was held on Monday, April 9, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 1:35 p.m.    
          
         The following members arrived after the roll was called:   
         Senator David Bernsen

         The chair laid out SB1098 and recognized the author, Senator  
         Madla, to explain the bill.  Senator Ellis sent up a committee  
         substitute; the chair recognized Senator Madla to explain the  
         difference between the committee substitute and the bill as  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
          
         The clerk called the roll.  There was a quorum present.  
          
         Senator Ellis moved adoption of the minutes from the previous  
         hearings held on April 2, 2001, and April 4, 2001; without  
         objection, it was so ordered.   
          
         Senator Ellis moved adoption of the committee substitute for  
         SB1098; without objection, it was so ordered.  The chair moved  
         that SB1098 be left pending; without objection, it was so  
         ordered.   
          
         The chair laid out SB1001 and recognized the author, Senator  
         Zaffirini, to explain the bill.   Senator Ellis sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Ellis moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Brown moved that  
         SB1001 do not pass but that CSSB1001 be reported back to the  
         Senate with the recommendation that it do pass and be printed.

         present not voting, and 0 absent.  Senator Brown moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.

         Nelson, to explain the bill.  Senator Brown sent up a committee  
         substitute; the chair recognized Senator Nelson to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Brown moved adoption of the committee
