         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, April 25, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:02 a.m.  The  
         following business was transacted: 
          
         The chair laid out SB1814 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator Truan sent up a committee  
         substitute; the chair recognized Senator Ellis to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Truan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB1814 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Truan moved that SB1814 do not pass but that  
         CSSB1814 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 3  
         absent.   
          
         The chair laid out SB350 and recognized the author, Senator  
         Truan, to explain the bill.  Senator Truan sent up a committee  
         substitute; the chair recognized Senator Truan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Truan moved adoption of the committee  
  
         substitute; without objection, it was so ordered.  Senator Truan  
         moved that SB350 do not pass but that CSSB350 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Truan moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out HB506 and recognized the Senate sponsor,  
         Senator Staples, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that HB506 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Staples moved that HB506 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent.  Senator Staples moved that the bill  
         be recommended for placement on the Local & Uncontested

         that HB2218 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion

         voting, and 1 absent.  Senator Staples moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;

         The chair laid out SB1753 and recognized the author, Senator  
         Cain, to explain the bill.  Senator Cain sent up a committee  
         substitute; the chair recognized Senator Cain to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Cain moved adoption of the committee substitute;  
         without objection, it was so ordered.  Witnesses testifying and

         Bivins moved that SB1753 be left pending; without objection, it  
         was so ordered.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB1818 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB1818 be reported favorably to the Senate  
  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 6 ayes, 0 nay, 0 present  
         not voting, and 3 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         Senator Bivins resumed the chair.   
          
         At 9:50 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 2:35 p.m. the committee reconvened.   
          
         The chair laid out SB1317 and recognized the author, Senator  
         Staples, to explain the bill.  Senator Staples moved that the  
         committee reconsider the vote by which the previous substitute  
         was adopted;  there being no objection, it was so ordered.   
         Senator Staples sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Staples requested unanimous consent to incorporate amendments  
         into the bill to create a committee substitute; without  
         objection, it was so ordered.  Senator Staples then moved that  
         the new committee substitute be adopted; without objection, it  
         was so ordered.  Senator Bivins moved that SB1317 be left  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Staples moved that SB1317 do  
         not pass but that CSSB1317 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Staples moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.

         The chair laid out SB1817 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee

         absence of the author, to explain the bill.  Senator Nelson sent  
         up Committee Amendment 1 and moved adoption; without objection,

         requested unanimous consent to roll the amendments into a  
         committee substitute; without objection, it was so ordered.   
         Senator Nelson then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  Senator Bivins  
         moved that SB1636 be left pending to await a quorum; without  
         objection, it was so ordered. Upon arrival of a quorum, Senator  
         Van de Putte moved that SB1636 do not pass but that CSSB1636 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Van de  
         Putte moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The chair laid out SB273 and recognized the author, Senator  
         Armbrister, to explain the bill. Witnesses testifying and

         Senator Nelson moved to pull down the previously offered  
         substitute; there being no objection, it was so ordered.   
         Senator Nelson sent up a committee substitute; the chair  
         recognized Senator Armbrister to explain the difference between  
         the committee substitute and the bill as filed.  Senator Nelson  
         sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted.  Senator Nelson requested  
         unanimous consent to roll the amendments into a committee  
         substitute; without objection, it was so ordered.  Senator  
         Nelson then moved that the committee substitute be adopted;  
         without objection, it was so ordered.  Senator Bivins moved that  
         SB273 be left pending to await a quorum; without objection, it  
         was so ordered.  Upon arrival of a quorum, Senator Nelson moved  
         that SB273 do not pass but that CSSB273 be reported back to the  
         Senate with the recommendation that it do pass and be printed.

         requested unanimous consent to roll the amendments into a

         Senator Bivins then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  Witnesses

         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Truan moved that SB702 do not pass but that

         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.

         hearings held on April 18, 2001, and April 23, 2001; without  
         objection, it was so ordered.
