         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, April 4, 2001, in the Capitol Extension, Room  
         E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:03 a.m.  The  
         following business was transacted:   
          
         The chair laid out SB1190 and recognized the author, Senator  
         Ellis, to explain the bill, along with former Ambassador Ann  
         Armstrong.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator Nelson moved that SB1190 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out SB641 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB641 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out SB1102 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB1102 be left pending; without objection, it  
         was so ordered.   
          
         At 9:50 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
         At 1:45 p.m. the committee reconvened.   
  
         The chair laid out SB914 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Staples sent up a committee  
         substitute; the chair recognized Senator Ogden to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Staples moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB914 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB1472 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and

         Bivins moved that SB1472 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Nelson moved that SB1472 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 8 ayes, 0 nay, 0 present  
         not voting, and 1 absent.  Senator Nelson moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB752 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Truan sent up a  
         committee substitute; the chair recognized Senator Barrientos to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Truan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses

         objection, it was so ordered.   
          
         The chair laid out SB1186 and recognized the author, Senator  
         Shapleigh, to explain the bill.   Senator Bivins sent up a  
         committee substitute; the chair recognized Senator Shapleigh to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.   Senator  
         Bivins moved that CSSB1186 be left pending to await a quorum;  
         without objection, it was so ordered. Upon arrival of a quorum,  
         Senator Zaffirini moved that SB1186 do not pass but that  
         CSSB1186 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.

         Shapleigh, to explain the bill.  Witnesses testifying and

         Bivins moved that SB1260 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out SB1180 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Witnesses testifying and  
  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB1180 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Zaffirini moved that SB1180 be reported back to the  
         Senate with the recommendation that it do pass and be printed.

         filed.  Senator Nelson moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Bivins moved that SB1735 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Van de Putte moved that SB1735 do not pass but that  
         CSSB1735 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.  Senator Van de Putte moved that the bill be certified  
         for the local and uncontested calendar,  the motion was then  
         withdrawn at the request of the author so the bill may be  
         amended  on the Senate floor. 
          
         The chair laid out SB1543 and recognized the author, Senator  
         Nelson, to explain the bill.  Senator Nelson sent up a committee  
         substitute; the chair recognized Senator Nelson to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Nelson moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB1543 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Nelson moved that SB1543 do not pass but that

         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.  Senator Nelson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.

         quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Zaffirini moved that HB1753 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Zaffirini  
         moved that the bill be recommended for placement on the Local &

         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB704 and recognized Senator Bivins, in the  
         absence of the author, to explain the bill.  Senator Bivins  
         moved that the previously adopted substituted be pulled down,  
         there being no objection, the motion prevailed.  Senator Bivins  
         sent up a committee substitute; the chair recognized Senator  
         Bivins to explain the difference between the committee  
         substitute and the bill as filed.  Senator Bivins moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Zaffirini moved that SB704 do not pass but  
         that CSSB704 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 3 absent.   
          
         Senator Bivins resumed the chair.

         Senator Zaffirini moved adoption of the minutes from the  
         previous hearings held on March 28, 2001, and March 29, 2001;

         There being no further business, at 5:35 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
