         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, March 21, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:10 a.m.  The  
         following business was transacted:   
          
         Senator Zaffirini moved adoption of the minutes from the  
         previous hearing held on March 14, 2001; without objection, it  
         was so ordered.   
          
         The chair laid out SB1671 and recognized the author, Senator  
         Jackson, to explain the bill.  Senator Staples sent up a  
         committee substitute; the chair recognized Senator Jackson to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Staples moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Shapiro moved that SB1671 do not pass but that  
         CSSB1671 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 5 ayes, 1 nay, 0 present not voting, and 3  
         absent.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB385 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that CSSB385 be left pending to await a  
         quorum; without objection, it was so ordered.  Senator Bivins  
         moved that SB385 do not pass but that CSSB385 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Bivins resumed the chair.   
          
         The chair laid out SB621 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Sibley sent up  
         Committee Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Senator Sibley requested unanimous  
         consent to roll the amendments into a committee substitute;  
         without objection, it was so ordered.  Senator Sibley then moved  
         that the committee substitute be adopted; without objection, it  
         was so ordered.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  Senator Bivins moved that  
         CSSB621 be left pending to await a quorum; without objection, it  
         was so ordered.  Upon arrival of a quorum, Senator Truan moved  
         that SB621 do not pass, but that CSSB 621 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         The chair laid out SB924 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB924 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out SB350 and recognized the author, Senator  
         Truan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB350 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out SB974 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Staples sent up a committee substitute; the chair recognized  
         Senator Wentworth to explain the difference between the  
         committee substitute and the bill as filed.  Senator Staples  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Bivins moved that CSSB974 be left  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Sibley moved that SB974 do not  
         pass, but that CSSB 974 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 1 nay, 0 present not  
         voting, and 1 absent.   
  
         At 10:50 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 1:38 p.m. the committee reconvened.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB579 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Van de Putte sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Van de  
         Putte requested unanimous consent to roll the amendments into a  
         committee substitute; without objection, it was so ordered.   
         Senator Van de Putte then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  Senator  
         Zaffirini moved that CSSB579 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Truan moved that SB579 do not pass, but that CSSB 579 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 7  
         ayes, 0 nay, 1 present not voting, and 1 absent.   
          
         The chair laid out SB580 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Senator Van de Putte sent up  
         Committee Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Senator Van de Putte sent up Committee  
         Amendment 2 and moved adoption; without objection, the amendment  
         was adopted.  Senator Van de Putte requested unanimous consent  
         to roll the amendments into a committee substitute; without  
         objection, it was so ordered.  Senator Van de Putte then moved  
         that the committee substitute be adopted; without objection, it  
         was so ordered.  Senator Zaffirini moved that CSSB580 be left  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Truan moved that SB580 do not  
         pass, but that CSSB 580 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out SB1057 and recognized Senator Bivins, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Zaffirini moved that SB1057 be left pending to  
         await a quorum; without objection, it was so ordered. Upon  
         arrival of a quorum, Senator Truan moved that SB1057 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 9

         moved that the bill be recommended for placement on the Local &

         explain the difference between the committee substitute and the  
         bill as filed.  Senator Van de Putte moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Senator Bivins moved that CSSB704 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB596 and recognized the author, Senator  
         Duncan, to explain the bill.  Senator Sibley moved to withdraw  
         the previously adopted committee substitute;  without objection,  
         it was so ordered.   Senator Sibley sent up a committee  
         substitute; the chair recognized Senator Duncan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Sibley moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Sibley moved that SB596 do not pass but that CSSB596 be reported  
         back to the Senate with the recommendation that it do pass and

         absence of the author, to explain the bill.  Senator Bivins sent  
         up Committee Amendment 2 and moved adoption; without objection,  
         the amendment was adopted.  Senator Bivins requested unanimous  
         consent to roll the amendments into a committee substitute;  
         without objection, it was so ordered.  Senator Bivins then moved
