         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, March 7, 2001, in the Capitol Extension, Room  
         E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:08 a.m.  The  
         following business was transacted:   
          
         Senator Zaffirini moved adoption of the minutes from the  
         previous hearing held on March 5, 2001; without objection, it  
         was so ordered.   
          
         The chair laid out SB104 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Van de Putte moved that SB104 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 9 ayes, 0 nay, 0  
         present not voting, and 0 absent.  Senator Van de Putte moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB728 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Van de Putte moved that SB728 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB218 and recognized the author, Senator  
         Shapiro, to explain the bill.  Witnesses testifying and  
  
         registering on the bill are shown on the attached list.  Senator  
         Shapiro moved that SB218 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 6 ayes, 2 nays, 0 present  
         not voting, and 1 absent.   
          
         The chair laid out SB266 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Nelson sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  Senator Bivins moved that SB266  
         be left pending; without objection, it was so ordered.   
          
         At 10:50 a.m. Senator Nelson moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 2:10 p.m. the committee reconvened.   
          
         The chair laid out SB430 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Shapiro sent up a  
         committee substitute; the chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Shapiro moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Shapiro sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Shapiro  
         requested unanimous consent to incorporate amendments into the  
         committee substitute; without objection, it was so ordered.   
         Senator Shapiro then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Truan  
         moved that SB430 do not pass but that CSSB430 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
          
         The chair laid out SB462 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB462 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Zaffirini moved that SB462 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 9 ayes, 0 nay, 0  
         present not voting, and 0 absent.  Senator Zaffirini moved that  
         the bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out SB450 and recognized the author, Senator  
         Duncan, to explain the bill.  Witnesses testifying and

         Staples moved that SB450 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The

         The chair laid out SB477 and recognized the author, Senator  
         Bernsen, to explain the bill.  Witnesses testifying and

         Bivins moved that SB477 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Van de Putte moved that SB477 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Van de Putte moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB518 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Senator Van de Putte sent up a  
         committee substitute; the chair recognized Senator Lucio, Jr. to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Van de Putte moved adoption of the  
         committee substitute; without objection, it was so ordered.

         pass but that CSSB518 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Truan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB524 and recognized the author, Senator  
         Armbrister, to explain the bill.  Witnesses testifying and

         Bivins moved that SB524 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,

         present not voting, and 2 absent.

         absence of the author, to explain the bill.  Witnesses

         await a quorum; without objection, it was so ordered.  Upon  
         arrival of a quorum, Senator Zaffirini moved that SB538 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 7  
         ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Van de  
         Putte moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         Senator Bivins resumed the chair.   
          
         The chair laid out SB826 and recognized the author, Senator  
         Truan, to explain the bill.  Senator Truan sent up a committee  
         substitute; the chair recognized Senator Truan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Truan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses

         a quorum; without objection, it was so ordered.  Upon arrival of

         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted.  Senator Bivins moved that  
         SB646 be left pending; without objection, it was so ordered.

         There being no further business, at 5:55 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
