         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, February 14, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:05 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out SB76 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Nelson moved that SB76 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator  
         Nelson moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The chair laid out SB158 and recognized the author, Senator  
         Truan, to explain the bill.  Senator Truan sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  Senator Truan requested  
         unanimous consent to roll the amendments into a committee  
         substitute; without objection, it was so ordered.  Senator Truan  
         then moved that the committee substitute be adopted; without  
         objection, it was so ordered.  Senator Truan moved that SB158 do  
         not pass but that CSSB158 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 9 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
         The chair laid out SB165 and recognized the author, Senator  
  
         Madla, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Madla to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Bivins moved that SB165 be left  
         pending; without objection, it was so ordered.   
          
         The chair laid out SB189 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.

         the attached list.  Senator Nelson moved that SB189 do not pass  
         but that CSSB189 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 9 ayes, 0 nay, 0 present not  
         voting, and 0 absent.  Senator Van de Putte moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Nelson moved adoption of the minutes from the previous  
         hearing held on February 7, 2001; without objection, it was so  
         ordered.   
          
         The chair laid out SB230 and recognized Senator Van de Putte, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB230 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB263 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Bivins moved that SB263 be  
         left pending; without objection, it was so ordered.   
          
         The chair laid out SB265 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB265 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out SB403 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up  
         Committee Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Witnesses testifying and registering on  
         the bill are shown on the attached list.  Senator Zaffirini  
         requested unanimous consent to roll the amendments into a  
         committee substitute; without objection, it was so ordered.   
         Senator Zaffirini then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  Senator  
         Zaffirini moved that SB403 do not pass but that CSSB403 be  
         reported back to the Senate with the recommendation that it do  
  
         pass and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator  
         Zaffirini moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB388 and recognized the author, Senator  
         Bivins, to explain the bill. Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Shapiro sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Bivins requested unanimous consent to roll the amendments into a  
         new committee substitute; without objection, it was so ordered.   
         Senator Bivins then moved that the committee substitute be  
         adopted; without objection, it was so ordered.  Senator Bivins  
         moved that SB388 do not pass but that CSSB388 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.    
          
         Senator Bivins resumed the chair.   
          
         There was no action taken for the following bill(s): SB 207 and  
         SB 349. 
          
         There being no further business, at 10:50 a.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
