         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Tuesday, March 20, 2001,  
         in the Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 9:05 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out SB1150 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Lindsay sent up a  
         committee substitute; the chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lindsay moved adoption of the committee  
         substitute; without objection, it was so ordered. Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.   Senator Lindsay moved that SB1150 do not pass but that  
         CSSB1150 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 5 ayes, 0 nay, 0 present not voting, and 2  
         absent. Senator Lindsay moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.    
          
         The chair laid out SB569, SB881, Sb882, Sb883, Sb1228. The Chair  
         recognized Senator Nelson to explain SB 881, SB882 and Sb883.    
         The Chair recognized Senator Cain to explain SB569. Witnesses  
         testifying and registering on the bills are shown on the  
         attached list.  The Chair recognized Senator Carona to explain  
         SB 1228. Senator Madla moved that the bills be left pending;  
         without objection, it was so ordered.   
         The chair laid out SB581 and recognized the author, Senator  
  
         Duncan, to explain the bill.  Senator Staples moved that SB581  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.   
         Senator Staples moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The chair laid out SJR32 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and registering  
         on the bill are shown on the attached list.  Senator West moved  
         that SJR32 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
          
         Senator Madla moved that the committee stand recessed until 30  
         minutes after adjournment of the Senate; without objection, it  
         was so ordered.   
          
         At 1:45 p.m. the committee reconvened.   
          
         The chair laid out SB802 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Madla moved that SB802 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Staples moved that SB802 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 0 absent.  Senator Whitmire moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Public testimony resumed for SB 569, SB881, SB882, Sb883 and  
         SB1228. Witnesses testifying and registering on the bills are  
         shown on the attached list.  Senator Staples moved to have the  
         staff record the names of witnesses registering on thse bills  
         without having their names read into the record;without  
         objection it was so ordered. The chair referred SB 569, SB881,  
         SB882, Sb883 and SB1228 to a subcommittee for further  
         consideration.  The chair appointed Senator Staples as chair of  
         the subcommittee and Senators Lindsay, and Cain as members of  
         the subcommittee.  The Chair requested the subcommitee to report  
         back to the full committee in two weeks.  
          
         The chair laid out SB847 and recognized Senator Staples, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Staples moved that SB847 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Staples moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
  
         The chair laid out SB874 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Lindsay sent up a  
         committee substitute; the chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lindsay moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Lindsay moved that SB874 do not pass but that  
         CSSB874 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Lindsay moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The chair laid out SB1158 and recognized the author, Senator  
         Fraser, to explain the bill.  Senator Madla moved that SB1158 be  
         left pending to await a quorum; without objection, it was so  
         ordered.  Upon arrival of a quorum, Senator Lindsay moved that  
         SB1158 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 0

         The chair laid out SB944 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Senator Staples sent up a  
         committee substitute; the chair recognized Senator Van de Putte  
         to explain the difference between the committee substitute and  
         the bill as filed.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  Senator Shapiro moved that  
         SB944 be left pending to await a quorum; without objection, it  
         was so ordered.  
          
         The chair laid out SB960 and recognized Senator Whitmire, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Whitmire moved that SB960 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 0 absent.   
          
         Senator Whitmire requested to be shown voting aye on SB 847 and  
         SJR 32; without objection it was so ordered. 
          
         The chair laid out SB916 and recognized the author, Senator  
         Jackson, to explain the bill.  Senator Whitmire sent up a  
         committee substitute; the chair recognized Senator Jackson to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Whitmire moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses

         CSSB916 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Staples moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Shapiro requested to be shown voting aye on SB 874,  
         SB960 and SB1158; without objection it was so ordered. 
          
         The chair laid out SB999 and recognized the author, Senator  
         Jackson, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Staples moved that SB999 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 0 absent.  Senator Whitmire moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Lindsay assumed the chair.   
          
         The chair laid out SB122 and recognized the author, Senator  
         Madla, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Madla moved that SB122 be left pending; without objection, it  
         was so ordered.   
          
         Senator Madla resumed the chair.  Senator Cain requested to be  
         shown voting aye on SB847, SB960 SB874, SB916, SB802, SB1158 and  
         SB999; without objection it was so ordered. 
         Senator Shapiro assumed the chair.   
          
         The chair laid out SB873 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Staples sent up a  
         committee substitute; the chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Staples moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Lindsay sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted. Senator Shapiro  
         moved that SB873 be left pending to await a quorum; without  
         objection, it was so ordered.   
          
         The chair laid out SB557 and recognized the author, Senator  
         Carona, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list. Senator  
         Shapiro moved that SB557 be left pending to await a quorum;  
         without objection, it was so ordered.   
          
         Senator Lindsay resumed the chair.   
          
         There being no further business, at 4:50 p.m. Senator Lindsay  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
