The House Committee on Judicial Affairs

         Pursuant to a notice posted on February 9, 2001, the House  
         Committee on Judicial Affairs met in a public hearing and was  
         called to order by the chair, Representative Thompson, at 2:19  
         p.m. 
          
         The roll was answered as follows: 
          
         Present:  Representatives Thompson; Capelo; Deshotel; Hinojosa;  
                   Solis, Jim; Talton; Uresti (7). 
          
         Absent:   Representatives Hartnett; Garcia (2). 
          
         A quorum was present. 
          
         (Representative Garcia now present.) 
          
         Rep. Hinojosa now chair. 
          
         The chair swore in all witnesses. 
          
         HB 587 by Reps.  
         Thompson/Haggerty/Sadler/Gallego/Danburg/et al 
          
         The chair laid out HB 587, the James Byrd, Jr. Hate Crimes Act,  
         and recognized the author, Rep. Thompson, to explain. 
          
         Rep. Thompson offered a complete committee substitute.  There  
         being no objection, the chair laid out C.S.H.B.587 and  
         recognized the author to explain. 
          
         Testimony was taken on HB 587 and CSHB 587.  (See attached  
         witness list.) 
          
         The chair moved that the committee stand at ease, pending the  
         departure of Mr. and Mrs. James Byrd, Sr.  There being no  
         objection, the committee stood at ease at 4:13 p.m. 
          
         At 4:22 p.m., the chair called the meeting to order. 
          
         The chair laid out HB 587 and CSHB 587. 
          
         Testimony was taken on HB 587.  (See attached witness list.)

         (Representative Solis, Jim in chair.) 
          
         (Representative Hinojosa in chair.) 
          
         Rep. Deshotel offered up committee amendment #1.  There being no  
         objection, the chair laid out 
         amendment #1 and recognized Rep. Deshotel to explain the  
         committee amendment. 
          
         Rep. Deshotel moved adoption of amendment #1.   There being no  
         objection, committee amendment #1 was adopted. 
          
         Rep. Solis offered up committee amendment #2.  There being no  
         objection, the chair laid out amendment #2 and recognized Rep.  
         Solis to explain the committee amendment. 
          
         Rep. Solis moved adoption of amendment #2.  There being no  
         objection, committee amendment #2 was adopted. 
          
         Rep. Uresti offered up committee amendment #3.  There being no  
         objection, the chair laid out amendment #3 and recognized Rep.  
         Uresti to explain the committee amendment. 
          
         Rep. Uresti moved adoption of amendment #3.  There being no  
         objection, committee amendment #3 was adopted. 
          
         The chair directed committee staff, with the consent of the  
         committee, to prepare a new complete committee substitute  
         incorporating the adopted amendments. 
          
         The chair laid out the new C.S.H.B. 587. Rep. Deshotel moved  
         adoption of the new C.S.H.B. 587.  There being no objection,  
         C.S.H.B. 587 was adopted. 
          
         Representative Solis moved that HB 587, as substituted, be  
         reported favorably to the full house with the recommendation  
         that it do pass and be printed. The motion prevailed by the  
         following record vote:  
          
         Ayes:               Representatives Thompson; Capelo; Deshotel;  
                             Garcia; Hinojosa; Solis, Jim; Uresti (7).  
         Nays:               Representatives Hartnett; Talton (2).  
         Present, Not Voting:     None  (0).  
         Absent:        None  (0).  
           
          Testimony was taken.  (See attached witness list.) 
          
         There being no further business, the chair moved that the  
         committee stand adjourned.  There being no objection, the  
         Committee on Judicial Affairs adjourned at 6:44 p.m.
