         Pursuant to a suspension of the 5-day posting rule on April 23,  
         2001, the House Committee on Redistricting met in a public  
         hearing and was called to order by the Chair, Representative  
         Jones, Delwin, at 2:15 p.m. 
          
         The roll was answered as follows:

                   Dunnam; Hunter; Keel; Luna, Vilma; Marchant;  
                   McClendon; Moreno, Paul; Pitts; Sadler (13).

         A quorum was present.

         The Chair again laid out the bill and the committee substitute. 
          
         The Chair announced that three amendments had been submitted  
         which did not fit into the statewide plan and therefore would  
         not be considered. 
          
         (Representative Wilson now present.) 
          
         The Chair laid out Amendment 01010H to the committee substitute.   
         Representative Pitts explained the amendment.  The amendment  
         failed by the following record vote:

                             Vilma; Pitts; Sadler; Wilson (6).  
           
         Nays:               Representatives Bosse; Counts; Dunnam; Keel;

         The Chair laid out Amendment 01012H to the committee substitute.   
         Representative Dunnam explained the amendment.  The amendment  
         was adopted by the following record vote:

         Mr. Marchant moved to reconsider the vote by which Amendment  
         01010H failed.  The motion to reconsider prevailed without  
         objection.

         Representative Sadler raised a question regarding conflicts in  
         Amendment 01010H and 01012H. 
          
         Representative Glaze moved to reconsider the vote by which  
         Amendment 01010H was adopted.  The motion to reconsider  
         prevailed by the following vote:

         Representative Pitts moved to reconsider the vote by which  
         Amendment 01012H was adopted.  The motion to reconsider

         The Chair moved that Amendment 01012H be left pending before the

         Representative Pitts laid out Amendment 01023H to the committee  
         substitute. The amendment was adopted by the following record

         The Chair moved that Amendments 01025H and 01026H be left  
         pending before the committee.  Without objection, it was so  
         ordered. 
          
         Representative Grusendorf inquired as to what was necessary for  
         an amendment to become part of the record. 
          
         Sharon Carter, House Parliamentarian, said that in order for an  
         amendment to become part of the record it must be laid out by  
         the Chair or offered by another committee member. 
          
         The Chair ruled that any amendments discussed in prior meetings  
         are not automatically a part of the record of today's meeting. 
          
         Mr. Marchant offered Amendment 01025H and moved its favorable  
         consideration. 
          
         Representative Christian answered questions from the committee. 
           
         Representative Bosse raised a point of order on the amendment on  
         the basis that the amendment violates the committee rule that  
         the adoption of any proposed amendment cannot result in  
         unassigned geography. 
          
         The Chair sustained the point of order. 
          
         Representative Grusendorf offered Amendment 01026H. 
          
         David Hanna, Texas Legislative Council, in response to a  
         question from the committee stated that Amendment 01026H does  
         not meet the test of proposing a plan which fits into the  
         statewide plan. 
          
         Representative Grusendorf raised a point of order against  
         Amendment 01026H and the Chair sustained the point of order. 
          
         Sharon Carter, House Parliamentarian, answered committee  
         questions regarding the process of considering amendments. 
          
         At 3:30 p.m., on the motion of the chair and without objection,  
         the meeting was recessed until 3:45 p.m., April 27, 2001. 
          
         The committee reconvened at 3:45 p.m. and was called to order by  
         the Chair, Representative Jones, Delwin. The roll was answered  
         as follows:

                   Dunnam; Grusendorf; Hunter; Keel; Luna, Vilma;

         A quorum was present. 
          
         The Chair inquired of the Parliamentarian as to the procedure by  
         which amendments with sustained points of order could be  
         reconsidered by the committee.  Sharon Carter, House  
         Parliamentarian, stated that it would require the committee to  
         suspend that portion of the rules and this would require a  
         two-thirds vote.   
          
         The bill was left pending and the substitute was withdrawn. 
          
         At 4:00 p.m., on the motion of the chair and without objection,  
         the meeting was recessed until 8:00 a.m., April 30, 2001.
