1-1 AN ACT
1-2 relating to stopping, standing, or parking a vehicle on a sidewalk.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 545.302, Transportation Code, is amended
1-5 by adding Subsection (h) to read as follows:
1-6 (h) If the governing body of a municipality or county
1-7 determines that it is necessary, the governing body may adopt an
1-8 ordinance or order allowing an operator to stop, stand, or park a
1-9 passenger car or light truck on a portion of a sidewalk that
1-10 extends across a private driveway if the driveway is not long
1-11 enough to permit the stopping, standing, or parking of the
1-12 passenger car or light truck on the driveway without stopping,
1-13 standing, or parking on the sidewalk. To the extent of any
1-14 conflict between the ordinance or order and Subsection (a)(2), the
1-15 ordinance or order prevails.
1-16 SECTION 2. This Act takes effect immediately if it receives
1-17 a vote of two-thirds of all the members elected to each house, as
1-18 provided by Section 39, Article III, Texas Constitution. If this
1-19 Act does not receive the vote necessary for immediate effect, this
1-20 Act takes effect September 1, 2001.
