HBA-JEK H.B. 3428 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3428 By: Merritt State, Federal & International Relations 4/2/2001 Introduced BACKGROUND AND PURPOSE The Texas Legislative Medal of Honor is currently the highest military honor that can be conferred to a member of the state military. House Bill 3428 establishes a new award, the Lone Star Medal of Honor, and requires a recipient of the Texas Legislative Medal of Honor to have the recommendation of the adjutant general. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3428 amends the Government Code to create the Lone Star Medal of Honor (Lone Star Medal), to be awarded only on the recommendation of the adjutant general to a Texan who has been awarded the Congressional Medal of Honor. The bill specifies that the Texas Legislative Medal of Honor (Legislative Medal) may be awarded only on the recommendation of the adjutant general and authorizes the governor or the governor's designee to award the Legislative Medal and the Lone Star Medal. The bill also authorizes the legislature to expend appropriated funds to award these medals, including funds to cover travel expenses for the honoree and the honoree's family for the presentation of the award. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect on the 91st day after adjournment.
