         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Health  
         Services was held on Tuesday, April 20, 1999, in the Capitol  
         Extension, Room E1.016, at Austin, Texas.

         The Chair called the meeting to order at 1:36 p.m.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         Senator Lindsay and Senator Nixon. 
          
         The Chair laid out the April 13,1999, minutes and recognized  
         Senator Moncrief who moved for their approval.  There being no  
         objection, the motion prevailed by unanimous consent. 
          
         At 1:39 p.m., Senator Moncrief assumed the chair.   
          
         The Chair laid out SB 377 and recognized the bill's author,  
         Senator Nelson, to explain the bill.   
          
         Senator Nelson sent up a committee substitute; the Chair  
         recognized Senator Nelson to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Nelson moved adoption of the committee substitute; without  
         objection, it was so ordered. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Nelson moved that SB 377 do not pass, but that CSSB  
         377 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
  
         Senator Nelson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out HB 677 and recognized the Senate sponsor,  
         Senator Nelson, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Nelson moved that HB 677 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         Senator Nelson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         At 1:54 p.m., Senator Nelson resumed the chair.   
          
         The Chair laid out SB 1086 and recognized the bill's author,  
         Senator Lindsay, to explain the bill.

         Senator Lindsay sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Lindsay moved that SB 1086, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 5 ayes, 0 nays,  
         0 present not voting, and 0 absent.   
          
         Senator Lindsay moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.

         recognized Senator Duncan to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Moncrief moved adoption of the committee substitute; without  
         objection, it was so ordered.

         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Moncrief moved adoption of the committee substitute;  
         without objection, it was so ordered.

         Senator Moncrief sent up three amendments; discussion was on  
         the substitute and the amendments. 
          
         The Chair moved that SB 1614 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out HB 1402 and recognized the bill's author,  
         Senator Madla, to explain the bill.

         Senator Madla sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         adoption; without objection, the amendment was adopted.   
          
         Senator Madla moved that HB 1402, as amended, be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 0 absent.  
          
         Senator Madla moved that SB 381 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1525 and recognized the bill's author,  
         Senator Madla, to explain the bill.   
          
         Senator Madla sent up a committee substitute; the Chair  
         recognized Senator Madla to explain the difference between the  
         committee substitute and the bill as filed.  Senator Madla  
  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.

         The Chair laid out SB 1524 and recognized the bill's author,  
         Senator Madla, to explain the bill.   
          
         Senator Madla sent up a committee substitute; the Chair  
         recognized Senator Madla to explain the difference between the  
         committee substitute and the bill as filed.   
          
         At 3:31 p.m., Senator Lindsay assumed the chair.

         Senator Madla withdrew his previous substitute and sent up a  
         new committee substitute; the Chair recognized Senator Madla  
         to explain the new committee substitute.  Senator Madla moved  
         adoption of the new committee substitute; without objection,  
         it was so ordered. 
          
         Senator Madla moved that SB 1524 do not pass, but that CSSB  
         1524 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent.   
          
         The Chair laid out SB 146 and recognized Senator Moncrief, in  
         the absence of the author, to explain the bill.

         At 4:50 p.m., Senator Madla assumed the chair.

         At 5:00 p.m., Senator Nelson resumed the chair.   
          
         Senator Moncrief moved that SB 146 be left pending; without  
  
         objection, it was so ordered. 
          
         The Chair laid out SB 1207, previously left pending, and  
         recognized Senator Moncrief, in the absence of the author, to  
         explain proposed changes to the bill.  Senator Moncrief sent  
         up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted.  Senator Nelson moved  
         that SB 1207, as amended, be left pending for a revised fiscal  
         note; without objection, it was so ordered. 
          
         Senator Nixon now absent. 
          
         The Chair recognized Senator Madla who moved to bring SB 1614  
         back up for consideration; there being no objection, the bill  
         which was left pending was brought up for re-consideration.   
         Senator Moncrief moved to reconsider his motion to adopt a  
         committee substitute to SB 1614; there being no objection, he  
         withdrew his motion to adopt the committee substitute.   
         Senator Madla moved that SB 1614 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 4 ayes, 0 nays, 0 present  
         not voting, and 1 absent.   
         No action was taken on SB 1618. 
          
         There being no further business, at 5:50 p.m., Senator Lindsay  
         moved that the Committee stand recessed, subject to the call  
         of the Chair.  Without objection, it was so ordered.
