                       SENATE COMMITTEE ON HEALTH SERVICES 
                             Thursday, March 4, 1999

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Health  
         Services was held on Thursday, March 4, 1999, in the Capitol  
         Extension Auditorium at Austin, Texas.

         MEMBERS PRESENT:                        MEMBERS ABSENT: 
         Senator Jane Nelson, Chairman           None 
         Senator Mike Moncrief, Vice-Chairman 
         Senator Jon Lindsay 
         Senator Frank Madla 
         Senator Drew Nixon

         The Chair called the meeting to order at 8:35 a.m.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:  
         Senator Madla and Senator Nixon. 
          
         The Chair laid out SB 445 and recognized the bill's author,  
         Senator Moncrief, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Moncrief to explain the difference between  
         the committee substitute and the bill as filed.  
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Moncrief moved that SB 445 be left pending; without  
         objection, it was so ordered.  At 9:57 a.m., the Chair moved  
         that the Committee stand recessed until 30 minutes after  
         Senate adjournment.  Without objection, it was so ordered.   
          
         The Chair called the meeting back to order at 12:10 p.m.   
         There being a quorum present, the following business was  
         transacted.  
          
         The Chair recalled SB 445 which had been left pending before  
         the committee and laid it out for consideration. 
         The Chair re-opened public testimony on SB 445 and a list of  
  
         those that testified is attached.  Public testimony was closed  
         on the bill.  The bill was left pending until a quorum was  
         present.  
          
         The Committee recessed at 12:20 p.m. until a quorum could be  
         re-established.  At 12:25 p.m., a quorum was present. 
          
         Senator Nelson sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Nelson sent up Committee Amendment 2 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Moncrief requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Moncrief then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.   
          
         Senator Moncrief moved that SB 445 do not pass, but that CSSB  
         445 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Madla requested unanimous consent to be shown voting  
         aye on CSSB 445. There being no objection the motion  
         prevailed.  
          
         There being no further business, at 12:35 p.m., Senator  
         Moncrief moved that the Committee stand recessed subject to  
         the call of the Chair.  Without objection, it was so ordered.
